That rule applies to this:
If a poster starts a selling or buying thread on CS, then that does not relate to the discussion board's ( Community Spirit, non ebay related) topic's.
It is off topic posts in a thread that is the issue here isn't it?

As far as i'm aware it has never been a reportable offence on CS or CW, so I can only assume it's a new ebay policy.

My understanding is that it relates to the topic started as well, I would be happy if you guys could check with the moderators for clarification but I think you will find that quite a few posters have had posts removed for being off topic within a thread:

So, if the topic of the discussion BOARD was for example, SELLING on eBay an off topic post would be about BUYING on eBay.
This board does not have a defined topic. Furthermore there is no rule about posts on a thread being off topic.
Someone show me the rule which states all posts on a thread must strictly keep to the topic of the OP?

That gives no indication that it relates to posts that are off topic on a thread.
It refers to the different discussion boards we have here, buying, selling ,craft, computer, CS etc... they all have a specific topic.
As in you wouldn't start a thread asking for computer help on the craft board.

perhaps because of a misunderstanding of what it actually means and the fact that the mods moderated the way they did....... things have changed here recently and mainly for the better, I think, re moderstion.
