A few years ago a mental health patient escaped from a forensic MH facility in Qld. This person was detained for serious arson. We were notified that he was just over the NSW border in police custody because of some minor offence. We asked the NSW police if they would drive him to the border where he would be collected by MH staff and returned to the forensic facility. They agreed. However, when they received the warrant they changed their mind because it was a mental health warrant. This led to a number of problems and delays, but the patient was eventually returned and thank goodness no one was harmed.
I have mentioned this because the "they" who don't look hard are the police. And it appears they don't look hard because they don't view a mental health warrant to be as serious or important as other arrest warrants. This attitude needs to change. The mental health staff have no legal right to apprehend an escapee in the community. Even if they looked hard hard days and found her, they would have to request police assistance unless she voluntarily agreed to return.
