The High Court has issued an interim injunction preventing the transfer to Sri Lanka of 153 asylum seekers who are missing on a boat bound for Australia.

The injunction, granted late on Monday in Sydney, applies at least until a hearing resumes on Tuesday afternoon at 2.15pm.

The asylum seekers are represented by Ron Merkel, QC, who argued to Justice Susan Crennan that the transfer was illegal because the asylum seekers had been deprived the ability to have their claims properly assessed.

But it is not clear whether the transfer has already taken place because Immigration Minister Scott Morrison has refused to comment and his lawyers told the court they had not received instructions.

Sources said lawyers were representing the asylum seekers through their families and they have not been in touch with them since contact was lost more than a week ago.

one of the few times a politician can be ordered to keep their mouth closed - pending Court action.

Make up your mind , first Morrison is criticised for not talking,  then when he does, and it is not palatable, it is dismissed.

I suggest  you accept what is being reported by  all the media outlets as to the background of the passengers (they are in Sri Lanka now) and the comment that they will all be released on bail (apart from the crew) because under Sri Lanka law they could have committed an emigration offence.

I believe what is widely reported as the ethnic  composition of the passengers.

So monman you think we can trust a politician that states "there is no incident occurring on sea" when:

1. Fairfax journalists had already spoken to the people on board the boat,
2. the Refugee Council had already taken down each person name and age,
3. and the Immigration staff on Christmas island were able to resport their exact location and were preparing themselves to accept them through their customs.

That is a surprisingly nebulous statement from someone usually so meticulous in quoting his sources.

I have seen at least one poster here taken severely to task by you for offering similarly  vague statements to justify a disbelief in climate channge.

Yes and easy to see why the send em back vote is meaningless. How can anyone give an informed answer if they don't have a clue what the question is about.
