Hi , regarding MS software and in context with this post , there are basically 2 major types of licenses , which have different conditions
One is oem ( original equipment manufacturer) whereby the software is sold to a system builder which attaches the license to a new machine and then sells the machine ( which is a condition of this license type)
The other is Fully Packaged Product (standalone) which is sold at retail only , whereby the recipient can attach to a new or oem machine and is licensed to personally use that machine without being obligated to sell the new machine
My guess is your software is oem and you are a private licensee of a never attached oem software incl key , and sought to sell
Distributing oem software + key by a private Seller is fraught with potential licensing complications
In the past there was a loophole to enable private Licensee distibution of orphan oem software + key , in obvious non-commercial quantities but I think has become more difficult now.
The oem EULA presumes a license is currently attached to a machine
Online auction sites seem to presume the license has been attached
But what of a non-branded ( so to speak) oem license bought by a private person at Authorised retail and decides not to attach the license and so the License is now surplus ? Are they obligated to return the unused license to the distributor for a full refund or is it supported to transfer (sell) the license to another Licensee ?
