I have spent months negotiating with a seller to get a replacement for an item that was never received by me and was returned to the seller by Post Office. (I have documentation of that).
After all this time and promises of a replacement, nothing has been received and I have asked the seller for a refund, which he has promised to do, but which has not been received.
How do I complain to eBay about this seller's behaviour?

I don't understand why you did not open an item not recieved dispute?
After 'months' it is too late to do through anything eBay
You may still have time to open a dispute via PayPal of you paid that way
Let me guess, the seller is registered in China and their feedback is terrible?
