How do sellers get away with saying sent 'Express Post' when clearly they do not use this service?

I am currently arguing with a power seller over their use of the term 'Express Post'.  The have sent my item via normal surface mail, not Express Post as stated in their ad.  There seems no way to stop them being so deceptive.
