item split in transit, poorly repackaged and arrived damaged

I bought 2 comic books on eBay but when the parcel arrived it only contained 1 book and it appeared to have been tampered with. After this a new parcel tracking was generated with the other book tagged to it. It arrived about 5 days after the first and was repackaged without the protective packaging of the original and arrived damaged. Presumably this was customs or similar. But the question is, who do I go to for recompense? I don't want to return the item as the damage isn't major and its a book I'd been looking for for a long time. In my view whoever repackaged it should pay compensation for damage, but what's ebay's answer?

You have these choices:

 

1) opening a return/refund request for INAD, and seller must pay for the tracked return postage (label to be provided to you) - which may mean the seller will just refund you for the item without requiring a return,

 

2) opening return/refund request and hoping seller offers a partial refund (no return required)

 

3) opening return/refund request and returning the item once the seller has provided the postage label,

 

4) just keeping the item if the seller doesn’t offer a partial refund.

 

Buyers can’t insist on a partial refund as that is not one of the MBG-mandated results, but it is an outcome that can be negotiated between the buyer and seller. You could indicate that it’s an outcome you would be happy to negotiate as an alternative to returning the item for a full refund.
