Ebay Witholding Shipping Funds

So Im here questioning the legality of witholding funds required for shipping items. 

Im not a big store, Im a personal seller who put up some items for sale because I needed the money.   Items sold, now Im expected to fork out a few hundred dollars for international shipping of my items, which Ebay has the gall to say is going to be witheld for 1 month. 

 

Now before anyone tried to defend this by linking to their policy, we need to understand that Ebay is simply a business, not a government or anybody that actually gets to decide whats law.  All of their terms and conditions have to abide by the laws of the countries in which they operate in.  Basically any country they have a country specific domain for, they need to be abiding by that countries laws. 

 

Under the laws here, that witholding of funds for a month means that I could technically withold shipping for that month too, as the money for the postage has been witheld from me.   But that creates a problem where I still wouldnt get the funds because I didnt ship the item.

 

Has anybody has success navigating the processes to actually get the funds to post items released?  Ive so far spoken to the ACCC and a lawyer friend of mine who both seem to think that Ebay has no legal right to withold that, and if Im expected to pay it and they withold the money then they forfeit any right to charge me fees on it, because I actually have the right to charge them fee's on the loan.

Really no point if you have no interest in hear factual replies

 

Get your lawyer friend to take them on

 

Being a personal seller has nothing to do with it, same rules for all sellers

 

Which you agreed to when listing

 

And no, you cannot withold shipping, again, you agree to the terms when listing

 

And the buyer would have every right to open an item not received case if you tried that on

 

In any case, you want to make up your own rules, ignoring what you agreed to so makes no difference what anyone here says
