Hi; I had a case opened for non deliver from a buyer who had a 40% non delivery looking at her feedback. Eventually Paypal refunded her money with no loss to me, Ebay did nothing. I did not think this was a sufficient response so I reported her to ACORN and received a case number but no action was taken.My question is has anyone on the forum board experienced a positive response from ACORN in short do ACORN do any investigating?

I had something similar recently - in my case the buyer opened a fraudulent not as described case and was told to return the items to me, but they sent an empty package instead. I was able to prove they didn't return anything, but PayPal still refunded the buyer (at no cost to me) - heaven knows why.
I knew ACORN wouldn't investigate because I suffered no loss and technically, since PayPal did the fraud was committed against them I suppose, but reported anyway because I wanted the incident on record, so if the buyer ever pulls a similar stunt and they do rip off another person, eBay, PayPal and the federal police will be able to see a pattern and maybe next time they won't get rewarded for proven fraud. ๐
ACORN do actually have a disclaimer on the site that not all reports will be investigated, but they are used to help gain greater insight into trends and methods, and ultimately (hopefully) result in better laws and methods to prevent fraud, so the more reports the better.

That is great news that you weren't out of pocket but it is still a worry, in a way. The person got away with it and if it has worked once, they might very well try again. I was just curious-does that 'buyer' know that you provided proof and that the paypal payment was discretionary?
If so, then it may put the wind up them & make them hesitate to try again too soon.

I'm not sure, in the email I got from PayPal, it said the case was closed in the buyers favour but "due to the uinque circumstances, we have decided to refund the buyer at no cost to you" so the buyer may have just received whatever PPs standard notification of winning a case is. (It's weird, though, because not only didn't it count against me in my seller standing, but eBay automatically removed the defects the buyer left via feedback, which usually happens when a case is closed in the seller's favour - the buyer's comment, remains, though, and sadly I can't get the reply function to work).
I suspect PayPal deemed my evidence circumstantial, despite the fact that I followed their advice when I contacted them about it (at that stage, I hadn't opened the package because I knew it didn't contain my products, but PayPal basically said to me that unless I can tell them what is actually inside, they'll just accept the buyer's tracking info and refund them, so the PayPal guy basically sat on the phone and listened to me open it - and photograph the entire process
I also included photos of the unopened package on scales, plus photos of the actual product that was supposed to be in there to show that it couldn't possibly contain what was sent to the buyer, then I sent some legal documents along with the photos).
This was my first dispute in several years of trading, and after that experience, if I could offer any advice to a seller who suspects a buyer of fraud - if you receive a return, wherever possible take it straight to the police station for a legal witness when it's opened, and to make a report if it turns out to be necessary (i.e. do not call PayPal until you can tell them what the contents are and submit a police report to them, preferably the same day the package is delivered).
