If a customer buys from me on ebay, can I keep their email address for further communication?

Can I keep email addresses.

You can keep it for transaction communication, if needs be, but NOT to send them advertising or promotional materials. That is considered spamming and can be reported, as eBay has a way to store sellers as favorites and the buyer can sign up to see your items by following you.

 

eBay tries to block the giving out of personal email addresses through the eBay messages system, to protect the buyer from unsolicited emails, and prevent off-eBay trades...not saying that is what you mean, but just their reasoning ๐Ÿ™‚

If you ask for their consent to do so.

harvest or otherwise collect information about users, including email addresses, without their consent.

That page doesn't exist Crikey...I get "moved or no longer available".

 

It is showing as .au, so it is not bouncing to the U.S., at least. But there is nothing there ๐Ÿ˜ž

Can I keep email addresses.

Members can send messages to each other through eBay. We encourage open communication between our members but we don't allow our members to use these options to send spam, offers to buy or sell off eBay, threats, profanity, or hate speech. We also don't allow members to exchange email addresses or links that do not directly help buyers and sellers complete a transaction on eBay. 

Make sure you follow these guidelines. If you don't, you may be subject to a range of actions, including your messages being blocked, limits of your buying and selling privileges and suspension of your account.

  • Email messages sent to a member on a mailing list without that member's prior permission

     

     

    The section on spam, says that.

     

    eBay members are asked to report spam, so don't keep them for automatic mailing lists ๐Ÿ™‚

Spam Act 2003


The three key steps you should follow are:

1 Consent - Only send commercial electronic messages with the addresseeโ€™s consent - either express or inferred consent.

2 Identify - Include clear and accurate information about the person or business that is responsible for sending the commercial electronic message.

3 Unsubscribe - Ensure that a functional unsubscribe facility is included in all your commercial electronic messages. Deal with unsubscribe requests promptly.

MESSAGES COVERED BY THE ACT
The Spam Act covers commercial electronic messages that are sent using applications such as:
โ€ข email;
โ€ข short message service (SMS);
โ€ข multimedia message service (MMS); and
โ€ข instant messaging (iM).

STEP 1 - CONSENT

Your commercial messages should only be sent when you have consent.

This may be express consent from the person you wish to contact โ€“ a direct indication that it is
okay to send the message, or messages of that nature.

It is also possible to infer consent based on a business or other relationship with the person, and their conduct.

WHAT IS โ€œEXPRESS CONSENTโ€?

You have received express consent from an addressee if that person has specifically requested messages from you. Examples of this include when:
โ€ข the addressee has subscribed to your electronic advertising mailing list;
โ€ข the addressee has deliberately ticked a box consenting to receive messages or advertisements
from you; or
โ€ข the addressee has specifically requested such material from you over the telephone.

WHAT IS โ€œINFERRED CONSENTโ€?
Consent may be inferred when the person you wish to contact has not directly instructed you to send them a message, but it is still clear that there is a reasonable expectation that messages will be sent.

You may be able to reasonably infer consent after considering both the conduct of the addressee and their relationship with you. For example, if the addressee has an existing relationship with you and has previously provided their address then it would be reasonable to infer that consent has been provided.

Other examples of where consent may be inferred are:
โ€ข when purchasing goods or services an addressee has provided their electronic address in the
general expectation that there will be follow-up communications;

โ€ข when an addressee has provided their address with the understanding that it would be used in
day-to-day transactions (such as online banking or business), and may be used for additional
communications (for example notification of related services or products);

โ€ข online registration of a product or a warranty;

I get very annoyed if I make a purchase from an online seller and they then use my email address to send newsletters or product promotions.

Me too am*3, they are all reported to my email provider as spam and if they sell more than one I send them on to their email provider with a request for them to stop it happening again.
