BTW that's the 37th day after the listing ended, not the 37th day after the case was opened.

Good point. That should probably be clarified...
I forgot to mention before that if you want a FVF credit, the very latest you can open a case by is the 32nd day after the listing has ended. That's because by the 37th day, any case will automatically expire and you won't receive a credit. So opening it on the 32nd day allows the mandatory 4 days and it can be closed on the 36th before it expires.
You can also use the Unpaid Item Assistant to automatically open and close cases within the right timeframe to receive the credit. Here's all the relevant info:

digital, I'm sure you are right, but we have definitelly totally forgotten about some, rang Ebay and was told by the girlie on the phone that Ebay will still pay you up to 60 days, and they did,
otherwise I wouldn't have told the OP to ask them.

You should self report that post, you are not allowed to name and shame members on these boards.
As you obviously failed to close the dispute why did you relist? At any time up until the dispute is closed the buyer can still make payment then you could end up with two buyers.
If you read the earlier posts properly they clearly said that if you do not close the dispute by the 37th day you will not get an automatic fee credit but one member has been successful in phoning ebay and getting the fee refund.
