Item not as described

So if an item is listed with pictures only and the title is purely what the item is eg: vacuum cleaner, toy, chair ,etc can the buyer claim money back because of item not as described when pictures showed what it is and the seller just states what the item is called?

once upon a time probably not, these days ebay are so hell bent on pleasing buyers at any cost YES

I would love to see the face of the ebay employee who draws the short straw trying to argue this point out with a seller in order to find in favour with the buyer on this.

They probably want you to ask questions before you buy. Like a game. I couldn't be bothered with a listing like that.

I'm putting forth a hypothetical, if this is what it takes to stop abuse of ebay's system so be it, they brought it on themselves.

Well, they could try and do a NAD but, despite eBay policies, blah, blah, if it's a new (or even 2nd hand item) under Aust Consumer Law (which eBay state is their default position) in a case like that it is up to the Buyer to ask questions prior to purchasing.  Actually no different than going into a real shop, spotting an item, buying it, taking it home and then complaining that it won't pick up pet hair.  If it didn't say it would on the in store advertising, packaging and you didn't ask the store staff if it would, tough for you.

If it was a Vacuum cleaner and didn't work when it arrived, then buyer could still open a snad.

To list an item, have to specify, new, bnwt, used, pre-owned etc.

Seriously who would by an item like an electrical appliance or piece of furniture or any other item not priced at bargain cost, which had NO info in the description area?
