Hi guys, I sold a phone worth $800 and I sent to the buyer's address without a signature (my mistake I didn't put signature for delivery) but I have a tracking number that it was delivered. The day that it was delivered the buyer sent me a message that it was stolen from his mailbox and he is requesting a refund and asked his local post office to investigate. Now he opened an eBay request.

the buyer replied and this is what he said 😑
"To keep you updated, the thief has sold the phone and the police aernt going to confront her anytime soon. Apparently this lady is under investigation from detectives for other thefts so it's going to get complicated. What we need to do now is block the phone, I'm not sure how you would do it but you are the original owner. Once blocked, whoever bought it will hopefully report her to police and the case will go further. As for the refund it sucks to be the guy, but we are going to have to let ebay decide. If it's my responsibility, I'll take the loss and wait until the investigation completes and when/if the phone is returned you'll have to unblock the imei. If ebay says you are at fault because of no signature and refunds me the money, I'll provide all the investigation numbers and police report numbers, and eventually they will post the phone back to you. This is a real unfortunate circumstances for both of us, and beleive me when I say I wish it hadn't happened. We can only wait."
and that's my reply to him just like what you said mate and I added if he can give me at least a screenshot of the thief or the phone that was stolen in facebook marketplace.

All you can do (if you so wish) is to reiterate to the buyer that your responsibility ended when the parcel was delivered.

I am beginning to doubt the phone was stolen.
Stand up for yourself, maybe report them to the cybertheft website. That in itself won't get your money back, if refunded, but it will put them on the radar.
DID YOU TELL THEM AT ANY TIME THAT IT WASN'T SENT SOD? This is important, as it would show that they knew the phone was delivered.
If eBay force a refund, report Paypal immediately to the Financial Ombudsman (they have changed their name, but the Countess will know). I doubt they will fight it, as you have proof of delivery.
Keep that in the holster for the nonce. It would be best to see what eBay determine first.
Edit: How the heck would the buyer know the 'thief' had resold it? Unless you live near a large body of water, the smell is not fish.

I didn't tell him that it doesn't have a SOD until I he messaged me the day it was delivered that it got stolen. I checked the tracking and the postman have a photo of it as well that it was delivered. Thanks for the advice mate I will contact paypal about this and I know they will understand me as a seller specially I got a tracking number and a photo as a proof. Thanks mate

Don't go with Paypal unless and until eBay uphold the INR claim.
ALWAYS work through eBay in the first instance. In this case, until eBay refund, there is nothing Paypal can or will do.
You need to keep your ducks (or fish) in a row. eBay, then Paypal, then prudential authorities.
