I've missed a part of the story here... why are the police involved?

buyer bought headphones from lestat (OP)
buyer didn't like headphones (I'm guessing there was a fault)
Seller issued refund without return of goods
buyer is happy to return goods, but feels that the seller should pay return post.
buyer currently has headphones and money
seller thinks police will do something about this and make the buyer return the headphones.

Your post was a little confusing with the buyer/seller reference - They can only be one or the other in this situation.
I am going to guess they are the buyer:
If you sold faulty headphones and he requested refund, you should have asked him to return to you and once you had them you would have refunded his money (and the cost of returning if you are a good seller).
My way of reading it is, he has the refund, the headphones, but is more than willing to send them back to you if you pay the cost.
While it is not a requirement for the seller to agree to this under paypal rules, if they are indeed faulty, IMO you should pay the return cost or accept the fact that you are not getting them back.
As said, police will not get involved, and you should have followed correct procedure in the first place rahter than letting it get to this stage.
edited to say - The buyer is not a thief and should not be referred to as one on a public forum - thankfully the mod's have edited out the name of the buyer so they will not be hurt by this.

Just checked your feedback - you may do well by reading up on eBay protocol for both buying and selling before going much further.
3 negs in such a short time does nothing to instill faith in you as a seller I am afraid.

Especially out of a total of 4 feedback as a seller.

wow you failed to honour an auction because you didnt get the money you wanted?
perhaps list the item starting at a price you are happy with next time?
*shakes head

Made me curious so i went to have a look. sjr, you've been too kind. The man is a total fool.
Fancy listing something at a certain price, then you get a bidder and post a sarcastic comment as if somehow the price was the bidder's fault. This item will NOT be sold for that LOL".
Boy oh boy, lucky I wasn't the bidder or I would have replied and asked why list it at that price then? That is one well deserved negative.
