Hi all , this is my first experience with a dispute and would appreciate a little help.
Buyer first emailed me through ebay listing and stated that the item powered up but was having problems.
Then a case was opened (some 14 minutes later) stating item did not power up.
The buyer has used the item and may have caused the problem .
The item is second hand ($300) , tested and worked before posting. No warranty was offered or implied.
Where do i stand in regards to refund , return postage and the fact that buyer misuse may have caused the problem.

Hi Geoff,
Your buyer will most likely open an 'Item Not As Described' INAD case unless you can both come to an amicable solution.
If it goes to that INAD case paypal will be involved.
I've never had a case like this so can't offer much help, but if you search within the discussion boards 'PAYPAL DISPUTE' or 'BUYER claiming INAD' you may be able to bring up other threads relating to this.
There are many who frequent the boards who will be able to advise you, I just wanted to let you know there will be someone along eventually.

PS Can you request photos of the item your buyer is claiming won't start ... Do you have say engine numbers .... can he change 'engine numbers' if he was in possession of a faulty one & just wanted a replacement without really paying ?

The OP clearly states that a dispute has already been opened.
Unless you can prove without any doubt that the buyer has mistreated the item, PP will tell the buyer to return the item, via a trackable postal method (at their expense), and once it is returned the original payment (in full) will be refunded to them.

Respond to the dispute that the item was in good working order, but once the buyer returns the item you will have it tested to deem whether or not any suggested damage could have been caused by misuse, and if so you will provide a written report accordingly. If the fault is confirmed as original, you will refund, if not the buyer can choose whether or not they want the item returned to the at their cost.
Alternatively you can offer a partial refund if the buyer wishes to have the item tested and repaired as the fault may be relatively minor, and this will save you more stress.
The item must be received back in exactly the same condition as it was sent.
