just found this new seller who thinks he can put free postage then write in the description if you choose free postage you cant claim refund for non delivery. have a look 321632720792

he can write whatever he likes. It doesn't matter to ebay or paypal they will refund anyway if the buyer finds there is something wrong with it or does not arrive.

OP, to me it always matters more what the seller's conditions are  - and I abide by them rather than Ebay's condition.

Their interference is way over board - after all I'm not buying anything of them.

In this case seller probably meant if change of mind is the reason - I would't refund postage part either.

 

harley - of course it matters a lot what the seller wants and how they want to set their conditions, such a blatant disregard, saying

"it doesn't matter what they want" - is out of line.

It's exactly the opposite from where I'm standing:

Ebay can say what they want - but I'm dealing with another individual who's selling something and setting down their conditions.

If I don't think they are fair and reasonable I don't have to deal with them - but to tollaly disrespect their wishes and still go ahead and buy it - no.

How can thousands of other sites function just fine - even better than Ebay - without all this carp - they all have their own conditions, 

and the only ones that should be relevant are all the compliances with consumer laws in that particular country.

That is all that Ebay as well should oversee - anything else is none of their busines.

Pfft don't tell me I'm out oif line!!

it doesn't matter what a seller says.If the buyer puts in a claim, Ebay and paypal have the final decision.

All other sites have their own coinditions because they own and run their own sites, when you are playng in ebays backyard you abide by ebays rules.

I had a read of the ad and to me, it came across as a very aggressive seller and it set my back up a bit.

I'm sorry, but if I bought and paid for an item and it did not turn up, I would be putting in an item not received claim to paypal and I presume that unless he could show some evidence that it had in fact been delivered, I would get a refund. I can't see that his advice to contact Aust post (further down in his ad) would or could work. He might hope to bluff buyers but the truth is he has absolutely no right to say a person cannot open a paypal claim if they have a case. What he is doing there is trying to impose his own conditions on how paypal works and that is not on.

 

 

I get the sense this seller may have been stung in the past by what he saw as an unreasonable claim but ranting and raving in an ad won't fix that, he needs to up his postage so he covers himself.

Sure, it may make it harder to get a sale, but he has to weigh that up against the risk.

 

Once upon a time on ebay, the seller could decide whether to give refunds or not, but these days with paypal, he isn't in charge. That is the bottom line. Ebay has its own set of rules and any buyer whose item does not arrive is probably likely yo open a dispute, whether he likes it or not.
