If a buyer pays, the seller is supposed to send, End of contract 1
If a seller refunds, is this a separate contract?
If a seller voluntarily refunds, the buyer has to accpet "ie mutually agree to cancel the contract" or through an arbitrary resolution process.
To me, the transaction that eBay has charged for has taken place, so why the fee credit?

Nothing except feedback has a 60 day limit on eBay.
If the buyer doesn't pay, you have to close a NPB case within 36 days of the transaction, which means you have to open it within 32 days.
if you ask for a mutual cancellation, I have no idea what the time limit is, but if the buyer doesn't respond within 7 days the case is AUTOMATICALLY closed and the seller gets their FVF refunded. The pitfall is that the buyer can reject the MC, in which case the seller doesn't get the credit, AND they can leave feedback.

Actually, zelly is correct about the timeframe when it comes to cancellations.
To cancel a transaction, both you and the buyer need to agree on the cancellation or you won't receive a final value fee credit.

When you send a mutual cancellation it is entirely up to the buyer if they accept it, refuse it or ignore it. If they accept it then all is well and good, if they ignore it you can close it after 7 days and then all is well and good.
If they refuse it then you have to look at why the transaction was not completed in the first place. If a seller has had no stock, if the item has arrived damaged or not arrived at all or there is any other reason it is the seller, not the buyer who wants to cancel then it is unlikely the buyer will agree, they will think you should suck it up and pay the fvf because you mucked it up. Having said that if you have a request from the buyer to cancel and they don't agree to the cancellation then you can call ebay, refer them to the buyer's email and they will usually refund the fvf.
