I have a buyer that has not payed for n item ended on the 22nd of August and have tried to cancel the tranaction but was refused by the buyer stating personal problems for not having completed the transaction.

Open an Unpaid Item Dispute now. Sounds to me, like you are being strung along for a fool. If you have sent him an invoice and he has not paid, open a dispute. They have had plenty of time.

You have 32 days to open an unpaid item case.

But unfortunately if the buyer declined a Mutual Cancellation, an unpaid case cannot be opened.
(Try anyway in case ebay has recently made changes in this area)

IMO you should RING eBay and seek that they review the messages between yourself and the buyer and that they cancel the transaction and credit your final value fees.
I would also seek their advice on whether they will remove any neutral or negative feedback the buyer may leave.

In my case all BIN, 4 days then an unpaid item automatically opens - no exceptions, no excuses allowed, Just a case of you buy you pay

Do you mean you sent a cancellation request which the buyer refused? If so you wouldn't be able to open an unpaid item dispute even if you hadn't left it too long, which you have. In future I would be more proactive if buyer's don't pay. I only give them 4 days, some sellers will give as many as 7 but whatever period you decide on stick to it. The only exception I allow is if they cantact me before bidding or buying to ask if they can have a bit longer to pay. I usually agree but make it very clear if they do not pay on that date a dispute will be opened immediately

Firstly I understand & sympathise with your situation, non payers are a pain. However, knowledge is power and it would pay you to perhaps read up on the" how to's" and "what ifs" of Selling on ebay, it will save you much future grief.
Have you set up a blocked buyers list? If not I would do so now and immediately add your painful non payers ID to it.
The advice you have already been given re 4days then open dispute either manually or automatically is spot on.
Right now in the situation you are in I too would call ebay & get them to walk you through your options so you can ultimately relist the item.
For very casual Sellers who may only list the odd item every now & then non payers are perhaps a lot more distressing than for regular Sellers who are used to rolling with the punches. Hope you get it sorted, best of luck in your future sales. 🙂
