How do you stop a seller from bypassing the dispute and feedback process

I have come across a seller who completely bypasses dispute and feedback by agreeing to refund or replace and then not following through.

Why does ebay allow this to happen.

To whom it may concern,

I bought this item in july and it took 3 weeks to arrive from China.

When I received the phone within 2 days I contacted the seller and informed them that it would not charge.

In the next 2 weeks I bought a battery and battery charger whilst trying al remedial actions that the seller asked me to take.

During this time I also found that the phone would not switch to high speed data transmission and informed the seller of this problem also.

I also sent the seller some links to web pages that stated that these were common faults with this phone.

The seller offered an exchange phone and I informed them that this would not resolve the data problem and that I would prefer a refund.

The seller agreed and asked me to return the phone for assessment and refund.

The phone arrived back in China and the post service tried unsuccessfully to deliver it on the 13 th of September.

I contacted the seller and told them of the attempt and that the post service had left a note to inform them that they were holding the parcel.

They said they did not receive a note and would go to the post office to ask about it and they said the post office there had a problem and that the was a Chinese holiday and they would not be contactable for 4 or 5 days.

The post office informed me the parcel was delivered and signed for on the 5 th of October and by the 12 th of October I had received no contact from the seller so I wrote to them and asked why they had not contacted me and that I would open a dispute if the did not resolve the issue again.

I have not received any answers since they asked me not to open any disputes which was over a month ago.

It is my belief that they have used delay tactics to push this case beyond dispute times.

Can you please ask them to give me my money back ?
