how do i report a seller which i brought and paid for a item on 22/10/12 and still no delivery and he/her will not respond to my 4 messages?

If you paid by paypal, and you have given ample time for the item to arrive ie 4 to 6 weeks if from OS, or 10 working days in Australia, then open an 'item not received' dispute via the transaction in paypal.
If you paid by other means, then you have opted for no buyer protection, and reporting them to ebay will do nothing, all they will do is tell you to contact the seller.
If you did pay by unprotected means, the seller is in Australia and the value warrants it, you can take all the details you have to the police, and report the seller to online fraud.
