I have tried to get a seller to replace an item that had 12mths warranty on it They acknowledged the issue and said they would replace the item but it hasnt arrived after numerous emails assuring me that it has been sent i have tried to go through the ebay site but it is almost impossible to lodge a claim as far as I can tell what should I do next

Claims in eBay can only be made within 30 days of the last estimated delivery date for INAD.
It is 180 days in PayPal from sale date.
If you are past the 6 months there is not much you can do to force the seller to replace the item.
Any product that has a warranty is better purchased in a known reputable store.
eBayers and other online accounts have very little to lose if they don't honour warranties.
They can close an account and set up another.
