What can I do when an item purchased has a fault and seller refuses to do a refund?

Item has a 12 month warranty. The seller said sent it back but I will be without it for 4 to 8 weeks or longer, but I need this item. Now they say it's fair wear & tear which isn't possible as I only bought it in March.  Unsure if anyone here can advise my next step.

Seller is registered in Hong Kong

 

For a warranty to be anything more than a word on the screen, the seller needs to be an authorised seller/re-seller AND registered in Australia

Unless the item was bought from an authorised Australian seller/reseller/distributor, the warranty is simply not valid.
