I purchased an item on ebay via paypal on 01/07/13. B4 buying I asked the seller many questions about the item.After buying the item i was informed they were out of stock(which i don't understand as in the listing it said 10 available). They have offered me an exchange but i don't want the exchange because it is different. Am i entitled to a refund and if they refuse a refund what can i do?
Tell the seller to refund you in full immediately, Do Not allow them to string you along with empty promises, If you do not receive your money back promptly, open a dispute for item not received and escalate to a claim as soon as you are able to.
Then I suggest you leave appropriate feedback, and my choice would be a neg, and mark their DSRs as 1, a 0 will not impact their rating.
