purchase and refund

I purchased an item on ebay via paypal on 01/07/13. B4 buying I asked the seller many questions about the item.After buying the item i was informed they were out of stock(which i don't understand as in the listing it said 10 available). They have offered me an exchange but i don't want the exchange because it is different. Am i entitled to a refund and if they refuse a refund what can i do?

Yes..of course you're entitled for a refund...seller's the one who stuffed up! & don't worry...I'm sure the seller will be happy to refund (I don't see why they wouldn't!)  but if they happen to refuse just do what shypansy said B-)
