Never received the item then tells you lies and does not refund and i have a statement from the post office no such parcel came in they are criminals and should be charged with fraud.

Read up on how eBay works and try to refrain from claiming the seller is a fraud and criminal just because you have not followed procedure.

The best thing you can do if you do not receive an item and there is no proof of delivery is to open a claim on ebay, an item not received claim, then follow through withina few days and get a full refund.
Don't let a seller delay you from making a claim within the time.
If that has happened to you, try a paypal claim as you have 180 days for that.
Claiming someone is a criminal seller isn't much use on this forum as it is only a small messageboard, you're not going to get your message out to many people.
On the other hand, getting a full refund and leaving negative feedback with the seller will have some effect on them and that's what you want.
