Can I get a refund?

Hi,

I bought a game from a seller and it was listed as 'like new' and had a stock photo with no additional pictures.

I have received the game there is a lot of sticker residue and dirt stuck on it and there is scuff marks all over the case. Most importantly it doesn't contain the manual, it was never mentioned in the listing that the manual wasn't included.

Also the seller charged 6.95 for postage, which was fine with me because that was the rate for a parcel. The game arrived in a small envelope with 'large letter $1.20' postage sticker. I am about to contact the seller but I just want to make sure I have my information clear. The listing says returns not accepted.

If the seller doesn't willingly provide a refund can I take the dispute to paypal and get a refund for item not as described? Is there any way I can make a claim for overcharge in postage?

Any help will be greatly appreciated thanks,

I think you would be better off phoning PayPal about the latest refund. If your account is relatively new, or you haven't made very many purchases, the case and refund might have flagged your account due to a high percentage of transaction issues. (eg if you've only made 5 purchases, 1 resulting in a refund and the other a case, that would automatically raise a flag for 40% of transactions made - as it's often automated, so not the result of a person reviewing your account activity and making a decision, it will be much better to phone them and get - or give - clarification of the specific circumstances).

The seller of the game would have been given 10 days to respond, so it seems likely the refund will be processed within a couple of days.
