I bought something from overseas and almost every signficant part was missing when it arrived. The seller was non apologetic (probably thought i was lying) and said they would send the missing parts via regular (slow) post. I gave them the benifit of the doubt and just waited for them to arrived. This was 6 months ago now. I now realise they lied and were just stringing me along so that by the time it was obvious what they were doing, it was too late and ebay won't help. I opened a cases in paypal and as expected no response from the seller but i thought paypal could help me in getting a partial refund. But nope they just closed the case and after i chase it up they tell me they won't help me becasue i 'didn't act in time' and now i can't open it again? Don't they look at these open cases?
I am now infurated as i have waited and did what i thought was the right thing and both ebay and paypal are not going to help me. They both seem happy to let this seller get away with it. The seems extrememly wrong and unfair. Surely i am not the first person to be scammed like this. Are there any other things i can do?

You've been an eBay member for 10 years, at least. Surely you could have dedicated 30 seconds per month to reading the fine print.
If I come across as condescending, it's probably because I am.
It tends to lead to ennui with members coming here with the same problems, when it is obvious from their posts that they don't think they should do any due diligence and want to rely on the site to protect them from themselves.

Do I understand correctly that you did open up the case in time, but you didn't escalate it within the timeframe of 20 days? That would hurt more than a carpet burn... Hmm. I don't think you can lodge a complaint with the Australian Financial Complaints Authority, as this is a consumer issue with PayPal offering a limited buyer protection by whose terms they've abided.
Really, the only possibility is to contact PayPal by phone. You can access the phone number and the one-time access code on the PayPal Buyer Protection page. You'd have to be incredibly polite, apologetic, beseeching and persuasive, and even then it may garner you nothing but a sense of "Why did I waste my time?"... but you've really nothing to lose but some time and your dignity. The latter you can always recover by singing along with Aretha Franklin here.
I would just also stress that, even though it is a PAIN reading T&Cs, it is best practice. Something affecting the ability to buy and sell is important. (However, it's known that a much smaller percentage of people do actually read those T&Cs than we like to think. You're in a lot of company...)
I'd also say that the major thing I value when I'm asking for help or advice is the quality of that help or advice. Sometimes there's no help or advice to mitigate a current situation, but at least I end up better informed for next time. If all I receive is fluff and sympathy, I don't feel that I have got what I need. I hope that at least we (meaning the community on these boards) have given you some good information to prevent this situation from ever happening to you.
I would very strongly suggest that you read eBay's Help pages concerning refunds, MBG, etc.
There is a wealth of advice here with the eBay community responders who know the insides and guts of eBay policies because they have had to work with those policies or within those policies. The policies do occasionally change as well, and that means keeping up with the changes so as not to be caught on the wrong foot.
I completely agree re never taking the "resend" option when it comes to a seller who's already proven him/herself dodgy. Refund is the way to go in such a situation.

If you have no patience for new members with the same problems you can always just move on and not reply? Given the "Kudos" your responses get just shows this forum rewards that kind of behahiour.

That is the issue.
You are not a new member. You have been a member for 14 years. I cut new members a lot of slack, but people who have been members for years more than I have don't get the same latitude.
If you have had the time to research what I have been given kudos for, many thousands of times, perhaps you would be better off spending that time on reading the 'fluff'.

Nope, what it shows is that those members agree with the comments made, and if you were to take the time to look at those member's profiles you would discover (fancy that) that they are experienced resonders to questions on the boards, with a lot of knowledge about how eBay works.

The good thing is you now have an incentive to read the 'fluff'.
And at least a basic idea of how not to be ripped off in future.
It might pay to keep up to date with the 'fluff' though. It evolves.

How long do you expect to be a member of ebay before you term yourself experienced?
You have been a member of ebay for 14 years and a member of the boards for 10 years.
In my books you should know the basics of how ebay works and how to to use the processes that you have been given to protect yourself.

I do know the basics and i don't consider myself anything special because my account is 14 years old. I was in an unusual circumstance because i gave a seller too much benefit of the doubt.
