G'Day People, On the 2nd December I paid for a set of oval Garnet ear- rings as a present cost $139.00 plus postage.
I messaged the seller and asked if they were posted as Ebay showed they were not posted and there was no tracking number.
I was told they they were posted the Saturday before Christmas and I should receive them Monday or Tuesday '
They arrived today 30/12/13.
I was annoyed and left negative feedback.
When the package was opened we found rectangular not oval ear rings were sent, the oval was listed in the Ebay listing.
Checking through the seller's feedback showed a smaller rectangular set sold previously listed at $79.00 that are a direct copy of what I received instead of the larger oval type for $139.00.
I feel very disgusted at the way this sale has gone and I am not happy about the deception.
It seems they never had what they listed and sent a substitute instead.
Is this acceptable.

I know that you've already been mucked around by this seller, but it's a pity you didn't contact them first to see if they were happy to sort it out (mainly so you could say that you tried!).
However, you can lodge an "Item Significantly as Described" claim. After you've done that you'll probably be told to return the item to the seller (with signature on delivery so they can't say it never arrived), before your refund is granted but you shouldn't have any problem given that they are the wrong shape - that's pretty definitive!
Just follow the process through and do everything Paypal advise and don't communicate directlly with the seller once the process is under way.

Thanks for your reply much appreciated.
Communication was very poor, questions I asked wer ignored and I was just told they would arrive Monday or Tuesday.
Request for a tracking number was ignored which made me doubt they were posted that Saturday.
Then the switch from the large oval garnets to the smaller rectangular cheaper ear-rings was the icing on the cake.

If it's the seller I found, she says in the listing:
"Items to be returned within 14 days of being received a 100% refund less the postage cost if goods are not as described."
Is this the item?

If you have paid with paypal, the seller can say whatever they like on the listing but it WILL NOT matter - Paypal has definite rules that negate anything a seller stipulates.
Follow through the process - the $10ish it would cost to return them is well worth it, IMHO.

Seems you are suggesting I believe part of the listing and disregard the rest?
My request for a tracking number was ignored.
I would be reluctant to post it back unorthorised fearing being told, we never received it.
Being that late is one thing, receiving a lesser priced article in place of the listing is quite another.
The one received is close to half to what I paid for.
Do you believe this was an accident?
I find that very difficult to accept.

Hi, Are you saying because I payed by Paypal that a seller has the right to list one article then substitute and post a lesser article in it's place? I am really glad the other 500 sellers I have delt with have not done this.

I agree. What I should have said was: contact the seller - tell her she has sent the wrong item - quote her guarantee to her - and ask for a refund. If it is not forthcoming - open a 'not as described' case and let PayPal handle it.
Do not wait too long, otherwise the time limit will run out.

open a paypal dispute for not as described
escalate to a CLAIM as soon as possible
return by signature on delivery, to the address paypal give you (NOT to any other address no matter what the seller asks)
let paypal deal with seller.

When you open the dispute be very specific about how different they are to the item you purchased, items have to be significantly not as described.
If Paypal find in your favour then you will have to return them, only send to the address given through the Paypal dispute and you must send by a qualifying delivery method so that means using the signature on delivery option.
If Paypal find in the seller's favour come back here, all is not lost and there are ways to proceed that will get you a refund.
