ring microsoft and report the seller, they have been known to give copies out as a thank you

Yep, as advised by fred_fred, call Microsoft.
If they determine that it is a fake, they will ask you to send it to them. Make sure you send it with some sort of proof of lodgement (for PayPal). Also ask Microsoft for some sort of documentation to state that it is a fake and that they have requested it to be sent to them.
If Microsoft do send you a genuine product then PayPal may not reimburse you as you have a product that you paid for.

Do a search on
"BRAND New Microsoft Project Professional 2010"
you'll see a new seller with feedback of 3 who is selling with the same picture as used by your seller on one of his other microsoft listings.
Is it just me or does that look very suspicious?
Hint - do the search and select completed items to see both items at the same time.

This is why I hesistate about buying mirosoft stuff on eBay, risk of fakes and oem when most sellers advertise the boxed product

yes, we all have to start somewhere, but there is no way I would buy anything like this from 0FB seller.

It's not just restricted to Ebay. Had seen on one of the Chinese wholesale sites, distributors on there with virtually any and every MS product, mostly under $10 a copy... "with new serial key"
Sent a link to Microsoft, never heard back from them, or followed up to see if they'd been shut down.

I would call Paypal, explain clearly that it is a counterfeit program and that you have had to return it to Microsoft. Ask them for a refund without return after you get confirmation back from Microsoft that it is a pirate copy. If they agree make sure you make a note of the time of the call and the operative's name and employee id number.
You may find once you have the proof and escalate to a claim that the info that no return is needed may not have been added to the file but then you can ask to speak to a supervisor and give them the details of the person who authorised the refund.
When I wanted a refund for a Microsoft product I did get my local repair shop to write a letter on headed paper confirming it was fake and used that to make the claim, meant I didn't have to wait or Microsoft.

don't worry about return... its illegal to send counterfeit products around. paypal will ask you to destroy it, thats all. You'll get an email, that you sign, saying its detroyed.
