The seller keeps giving me excuses over email and will not refund my money. They have apparently send a replacement 3 times but it has not arrived. They will not answer my questions and keep giving excuses. It is like they are cutting and pasting the same response.
I just want my money back.

I may have solved my problem as I found the seller also operated a store on facebook. I left a string of messages on there wall and have now been promised a refund. I will beleive it when I see it but if not I will continue to bombard their facebook wall 🙂

Yes hound them of facebook, look for them on twitter and instagram as well. I hate sellers like this it makes the honest sellers fume!!! Also I think it is very poor of the person you contacted at Ebay not to give you proper help, and you had to post on the forum here for help. That is very poor service from Ebay customer support.
And like every other person who has replied to you, never ever let a seller delay you from opening a dispute, if you have not received the item by 40 days (if it comes from overseas or even domestically, especially if your waiting for a repost) open a dispute case. You then have given the postie or seller more time and remember to raise it to a claim if you still haven't received it by the date paypal has given you.
If you do believe the seller and think it is the Australia Post's issue visit their website and make a complaint to them as well, there is an online form to fill in and they will get back to you.
Personally I think this seller has lied to you. But just never ever let a seller convince you not to protect yourself. If it was me I would of rather refunded you, and if you still wanted to purchase the item through me you would be allowed to do so but that way I can reassure you that have your buyer protection and I am an honest seller and worth your time to deal with.

Thanks for your reply. Unfortunately as the seller seems to have been stalling me it has been over 45 days so can I still open a dispute?

ps Darryn, you cannot name & shame on here. The Mods will remove the Seller ID shortly. As mentioned prior, do not let them stall you. It is a sly tactic. You have 45 days from purchase to do this.

Horizon....read the OP. The item was purchased in May, 5 months ago. What sort of dispute do you suggest the OP should open, because they certainly cannot open one in paypal?
OP, your only recourse now is if you funded a paypal payment with a credit card or Visa debit card...you can ask your bank about a chargeback but you need to act quickly as there are time limits for that. Some banks only allow 90 days.

Thank you all. Sorry for naming the seller I should have read the rules properly. I will have to try and contact the bank and see how I go. It is very frustrating.

For some reason it will not allow me to leave feedback for the item. Thankfully it is not alot of money but ebay could do without sellers like this. There recent negative feedback shows I am not alone on this issue and I have contacted ebay support to let them know.
The least I would like to see happen is for the seller to be prevented from treating others like this.
The money I am owed could have gone to much more usefull things or to a seller that actually cares about their customers.

Whilst the seller does deserve it, the OP is also out of time (by almost 3 months) to do that.
