I want to bid on this Asus tablet and it is listed as new and only taken out of the box for the photos but what I am not sure about is if it arrived DOA would I be covered with PayPal or under warranty with Asus. I emailed the seller but did not get a clear answer just a link to Asus website. This is what is stated on the item after the item details. Any help would be much appreciated as the item ends today.

If it is listed as fully functional then you would have recourse (within 45 days) with PayPal if it turns out to be faulty (but, obviously, not through misuse).
You would not have any warranty with Asus.

That wouldn't matter too much. Unless it's listed as "for spare parts", or faults are expressly stated in the listing, then the fact that it is in full working order is implied. In other words, listing it as 'brand new' with no faults stated means you would expect to receive a new, fully functioning item and if that's not what you get, you have a right to a refund, but no warranty in these circumstances unless provided by the seller, which it isn't going on the description you quoted.
I know it's everyone's own choice etc, but personally, I would steer clear of it. As is often mentioned on the boards, the few dollars more you pay from a bricks and mortar store for items like this is worth the confidence and peace of mind with a warranty and so forth.

My policy is, if it's electronic or computerised, only buy from a standing store.
You know the ones, they have a building, a front door, staff, and usually a help line. if the product goes belly-up.
I also like warranties, which you DON"T get when you buy here.
It's your choice.

Last time I bought a computer, which was 8 mnths ago it was cheaper to buy (NEWnot refurbished etc) from a b&m.
