Help with undelivered item

I just want to give you a run down to something that has soured my eBay experience quite a lot and would like to know what I can do.

 

I bought an LCD panel for a laptop repair from the UK (only place I could find this particular model), now after a long time waiting for the package to be delivered I noticed on the Australia Post website that it was underlived and was marked “return to sender” at the distribution centre near my address. Note that it wasn’t at a post office and after calling Australia Post it never attempted a delivery so I’m guessing the address was wrong except for the post code.

 

Upon contacting the seller he was absolutely no help what so ever and advised me solely to “contact ebay” and that’s it. I opened up a case with eBay directly not knowing this was the incorrect way of doing things and should have gone straight to PayPal. Ebay have basically wiped their hands with it multiple times now not realising that I have in fact not received my item I paid $200 for, this is the tracking ID that clearly shows no attempt from an AusPost driver and is marked return to sender at the Thomastown Distribution Centre;

Now as you can clearly see at the end it ends up in NSW on its way back to the UK specifically MASCOT POST SHOP and ALEXANDRIA PDC both approximately 850km from my address in Victoria. The problem is in eBay it shows the incorrect post code as the one in Thomastown as well “3072” for both mascot and Alexandria. I have explained this multiple times but have been advised that because it was in the “vicinity” of 30km from my address it is somehow “good enough” according to my last phone call.

 

How is this able to go on? The seller now has his item back (even if he doesn’t admit it), has the money I paid him as well and is off scot free. Now eBay has supposedly a ‘Money Back Guarantee’ which specifically states “Get the item you ordered or get your money back.” I do not HAVE my item therefore would like my money back. Why is this so difficult for eBay to understand? Is there a number I can call that I can talk to someone IN Australia who can understand the English language and reasoning?

 

I have also opened a case with the ACCC as this in my eyes is fraud, I would like to know what everyone’s thought on the matter are?

You can get the number for ebay through the help and contact link at the top of the page.

Did you by any chance fund the payment with a credit or Visa debit card? If you did then you could try your bank to see if you can do a chargeback.

 

The ACC probably wasn't the best bet, the usual plce to complain about this type of thing is the FOS. I don't know about ebay but with Paypal just the threat of going to the FOS, if you have solid proof, is usually enough to get you a refund also they are quite good at thinking outside the box if you get high enough up the food chain.

The number at the top is what I use but it goe to some asian country with people using fake names and have strange accents who don't understand what I'm saying half the time with distribution centres and suburbs etc. They just see 3072 next to a NSW suburb (incorrectly) and they think I have the item.

 

Kind of, I used my paypal account which is tied to a visa debit card.

 

I have gone on the FOS site but this seems to be more geared towards banking and finacials rather than purchases? Should I still lodge one?
