I had purchased an item in January which didn't arrive on time and I contacted the seller and they asked that I wait a little longer. I did so and contacted them again to which they kept responding saying to wait longer and check the post office which I did. They said they sent a replacement item which has never arrived either.
I am trying to open a case to get my money back from the seller but Ebay won't let me select the item because it older than 30 days and therefore won't let me email Ebay either cause it wants me to select an item first.
Does anyone know of or had experience with getting money back on an item older than 30 days and how to do it?
Any help will be much appreciated.

You bought from a Chinese seller, didn't you? Don't ever let them string you along and NEVER accept the offer to resend the item. Always opt for the refund. Yes, eBay disputes are only good for 30 days after the last ETA. I hope you didn't spend a lot of money, because PayPal disputes cut off after 180 days, or close to 6 months. You are too late for that now too. Sadly, you have lost your money. Sorry.
You won't hear from the seller again. They knew exactly what they were doing when they kept asking to wait a bit longer. In future, open a dispute and get a refund if your item hasn't arrived within 4 weeks. If the item does eventually turn up you can repay the seller.

Did you fund the payment with a Credit Card even if via payal?
If yes then call your bank and do a chargeback.
NEVER let a seller string you along to make things time out to take action.
If the items are from within Australia 3 weeks is ample time for an item to arrive.
Ask the seller for tracking as well to verify they have posted it by looking it up on the Aust Post tracking site or what ever company they used for shipping.
