How to get refund quickly if Seller(Dicksmith) fail to delivery my item

I place an order in Dicksmith on 22 Sep 2016, and now still not get my item.

I open a case on 7th Nov 2016, should be resolved in 48 hours. but now still hear nothing from dicksmith or ebay.

Hi I think my post is lost. still not resolved after 3 weeks contact Toll carrier and two week contact Dicksmith.

They are not willing to refund or replace for me. I already ask this for over one week. They keep asking me to be patience after ten business days investigating on this issue. They are quite annoy and hard to deal with.

Now, I am asking for a refund only. I am not willing to deal with them anymore. and not willing to wait another one to two month to get my item.

Please assist so I can get my money back ASAP. Very disappointed with the seller.  Will not buy anything from DickSmith and Kogan. Since this is not resolved I cannot risk to place a order to get a new phone. They are very good at procrastination. Please assist. Thanks

It sounds as though the seller has proof of sending the item with Toll.   What have Toll told you about the delivery?

If you opened the dispute in ebay on the 7th November it may have been too late to ask ebay to step in and help.

You could try opening a dispute in paypal....you have 6 months for that.

This is just a public forum not eBay staff and eBay don't even read here.

If you have opened a case through PayPal just keep going through that case to get the refund.

PayPal allows the seller a certain number of days to respond and if they cannot provide PayPal with tracked post for your item, you can escalate to a claim.

You left it very late to open a case.

This is not eBay; it is a members' board.

You needed to follow the rules. It is not enough to open a case. If you don't get satisfaction, you need to escalate it; which you seemingly didn't. Maybe you should, although a whole 2 days is hardly enough time to decide the issue hasn't been resolved.

Your best bet, if you paid by Paypal, is to open a not recieved dispute with Paypal. If you can't and you funded the purchase with a credit/debit card you MIGHT be able to do a chargeback through your bank.

A good rule of thumb is to READ THE RULES, especially where they pertain to timeframes. preferably BEFORE you have trouble.

As an aside, what happened is past tense, not present.

Ebay do not read these forums.....you are talking to buyers/sellers like yourself.

You have lodged a dispute which will take 4 days. Dick Smith will have to provide tracking details....if you get no satisfaction then contact ebay or come back  here for assistance.

After slowing down the OP and substituting English it would seem the item has been sent by Toll.

Whilst DS certainly should look into the issue, they would be covered for a Paypal dispute. So eBay/bank disputes are probably the only avenues.

It would help to know what Toll said, and if the OP actually has a tracking number. In which case they could find the delivery status for themselves. One of the handy features of tracking.

I do, however, fail to see how this is a DS issue (except for the inferred non-response). I do understand that a lot of people still subscribe to shooting the messenger.

It was easy to find the items via the negative feedback left. There is a 10 day handling time on those phones and they say a tracking number is emailed to the buyer after shipment. I'm not sure where the OP is, but if I bought one of the phones today, the ETA is 24/11 - 1/12 from Melbourne to NSW. That would mean the OP's rough ETA would have been 6/10 - 13/10. 30 days after the last date would be Nov 12, so it looks like they have been lucky enough to open an eBay dispute.

Probably a good thing given the amount of money they spent, because as you said, they are covered for a PayPal dispute if they provide a tracking number.
