How to open 2nd dispute for an item whilst 1st disput is still ongoing

Ok, bit of a weird question that makes me sound like a crazy coot but I don't think a seller has made me more infuriated then today.

 

I needed to replace a niche product that died on me a few weeks ago. I saw 2 exact replacements available online. One on Amazon only available from AmazonUK so it had a 2 week shipping timeline for $45-AUD. The other on here for $72-AUD but it had literal 2-3 day shipping (the shipping info was highlighted in green).

 

I chose the more expensive option on eBay because the suburb location was right next to me and I needed it before the next weekend (purchased Sunday night). After purchasing I messaged the seller and they said package is actually coming from their warehouse in South Australia (not the suburb location on the product listing), but I should have it by the weekend.

 

Anyway this was all lies because the package arrived today from the eBay seller,  IN... A... AMAZON... UK... BOX.....

 

Needless to say I don't think I've ever been as **bleep** as I was when I realised what the seller did. I know it's a low ticket item and probably not worse the hassle but it's sellers like this which basically want to to give up eBay all together and I just might if the seller even gets to keep a single cent of this purchase. 


I opened a case for item not received yesterday but now the item is here I want to open another dispute to return this product and get a full refund. Problem is if I close the initial case for item not received, eBay states I won't be able to open another case.

 

What's the best course of action here to get my money back outright from this seller, once the initial dispute for item not received is closed can I open up another ticket to return the item? Or is just a matter of letting my red mist subside and just be done with eBay once and for all and stick to Amazon?

This is eBays "Get It By"  for items close to home.

 

As opposed to  the usual longer estimated delivery dates.

 

You can  open an " item not as described" claim through eBay's Money Back Guarantee

Exclusions and special coverage when the item doesn't match the listing

 

The item arrived after the latest estimated delivery date

 

Covered   -  The return is treated as if the item didn't match the listing.

 You can't , for another item not received case.

 

If you close the  "item not received" case  you can open an " item not  as  described" case for the same item

 

Make sure you mention all the Amazon details to the case

was the box shipped from South Australia as they had said?

 

Had the box been opened and taped back up?

 

Why would you want to return the item if you genuinely needed this item?

 

My opinion, and it is just an opinion, is that you received what you needed ... at a price you were happy to pay ... quicker than if it had to come from the UK.

 

You can leave appropriate feedback to warn others, but you will need to be careful with the wording or it may be removed.

 

One last question ... if the seller had put the item in a plain box, without any branding, would you have come to these forums today?

Based on the fact that IMO, it indicates the parcel was  sent directly  from Amazon UK, this is why I advised the OP to add  the Amazon details into the "item not as described" dispute .

 

To me it reads " If I'd wanted it sent from Amazon UK, I'd have ordered it from there myself...and saved money"

 

1) It's against the rules

2) Buyers' details should NOT be  given to Amazon

 

With so many online places to shop, eBay needs all the buyers it can get and buyers are leaving because of all the shonky seller practices,  the constant item location misrepresentation, postage times - eBay have been  pushing  these

short 'get it by' dates, short 2-3 day delivery,  dropshippers etc.

Okay, Justin, I had a similar thing happen to me recently. Bought an item from ebay, although I had seen it cheaper on Amazon, but was much the same price once Amazon postage was factored in and I was not interested in joining Amazon Prime.

 

I actually received the item next day in an Amazon bag, but from a different seller (receipt was in the bag). I was incensed.

 

It's obvious to me that your seller has done something similar, bought direct from Amazon, had it shipped to you.

 

Now here's the thing, Justin.

 

Ebay sellers like this are leaving themselves wide open because I bet no tracking details were uploaded to ebay. Any tracking details will show the item was coming from Amazon.

So here's what I'd do. 

 

I'd wait a day or so and see if the seller does upload tracking details into your item not received claim. I would not close the case. Not yet.

If he does not load those tracking details, you will win the case. You will get a full refund. That would be the quickest resolution for you if you're after money back.

 

But just say he does load the tracking details and case gets closed in his favour, you CAN open an item not as described or item faulty once an item has been received. You could not have both types of cases open together as in not received/received but faulty. 

But you can open a claim for faulty AFTER a claim for not received has closed.

If you open a claim for a faulty item and close it, you won't be able to open another faulty claim for that item. So don't be persuaded to close anything on the seller's say so.

 

If you go this route, do as casey suggested. And I'd go hard, follow it through.

 

I usually agrree with K1000 but not in this case. You are entitled to get what an ad promises. Your ad had item as located in the next suburb, it had a tag suggesting fast shipping, it had a seller name. You only bought at that price point as you hoped to get it for the next weekend.

 

If you were going to get it late and from UK, you could have purchased direct from Amazon UK yourself. And if you get an ebay refund, you still can. The occasion you needed it for has come and gone. The seller let you down plus broke ebay's own rules about selling direct from a 3rd party.

 

Oh and give appropriate feedback once it has all been resolved. I gave my seller a neutral but in your case, I think a neg would not be unreasonable in the circumstances.

No, he would not have, if the terms of the sale had matched the ad.

If that item had come from where it was listed as being, had arrived in the time frame promised and from the seller who sold it.

I daresay that even if it had been posted quickly but then Auspost ran a few days late, Justin would have been disappointed it missed his special occasion, but understanding about it.

 

He wasn't complaining about the item or the price. he was willing to pay a premium for the item as advertised. But that's not what he got, was it? He got an item sent direct from AmazonUK.

If that happened to me, I'd be incensed.

And it is against ebay's own policy.

I'm not sure the OP's name is Justin.  I think his ID is justintense316.

 

Some parts of his post do come across as being 'intense' :

Getting so worked up as to be more infuriated  than ever before, SHOUTING, threatening  to never use eBay again because of one bad (although he did get the item he wanted) experience (we've all been there), not wanting the seller to keep a single cent . . . seems pretty intense to me, over a niche item he needs to replace one that died on him weeks ago.

 

Also, we don't know if the item came straight from Amazon, only that it was in an Amazon box.

 

The OP needs to clarify

- how long the item took to arrive?

- did it arrive direct from AmazonUK? or just in an AmazonUK box?

- had the seller bought the item before and was onselling? Possibly to recover funds he'd spent on an item he doesn't need?

 

It would be nice if the OP clarified some things . . . in a calm tone.

You could be right about his name, I can see it now, I did think Justin Tense was a bit unusual, but hey, I'll think of him as Justin.

 

If it arrived in an Amazon UK box, I'd be assuming it came from AmazonUK.

If the seller is just using old boxes, he would be well advised to steer clear of the exact box it originally came in as it  invites buyers to look into it and no one enjoys buying on ebay and getting their item from Kmart or Amazon. 

 

I don't think Justin would be as infuriated if his item had come direct from the seller and it obviously arrived late. Justin is upset because he knew it was much cheaper on Amazon, so he may as well have bought it there.

 

I could be wrong, maybe it  did come from sth Aust, but the ad, after all, did say it was in Justin's state. If it had mentioned SA, Justin may not have bought from that seller.

 

I think all this sort of thing does is reinforce the belief for many buyers that Amazon is a better, cheaper place to buy. It doesn't do the ebay image any good at all.

the item wasn't necessarily cheaper from AmazonUK.

 

A$45 is about £22 

Allow say £10 shipping (total = £32)

And 10% GST (total = £35)

and the price becomes around A$72

 

I looked at a few items on AmazonUK to see the shipping.  Not knowing what the actual niche item is makes it difficult to estimate shipping, but I went with shipping on a small, cheap item as an estimate  👇

We dont know if 'Justin' was charged for shipping, but the Aussie seller is not going to make any money selling for $72 as they have eBay fees to pay (fees around $10 if offering free postage).
