I did not receive an item, the Seller stated he would resend the item but I still did not receive it. Seller does not respond to my emails.... I paid $50.71 AU

I'm really sorry that you have learned such an expensive lesson.
You should still be able to express your feelings about the transaction in your feedback. (You have until 60 days)

you have been dealing on ebay for 10 years and you dont know not to let a seller string you along past the 45 day cut off time for opening a dispute
if you paid by a credit card notifiy your bank and you could do a charge back

I didn't know about the 45 days with eBay. WHY does eBay allow sellers like this who continnually every month do not send the items to the buyers. Yet these sellers still have a 96% + Feedback. But they continnue to steal and cheat and lie and avoid sending or replying to the buyers.

I would run a mile if I saw a seller with 96% feedback. I would not be coming here and complaining about the seller being "allowed" to trade on ebay. Feedback gives you the tools to find out how good a seller is.....if you ignore the warnings you can hardly blame ebay.

I would blame ebay.
If a seller (or a buyer, for that matter) has a bad track record, they should face a ban. It might not be forever, depending on the seriousness of the infringements, but eg a month/3 month/6 month ban might work. There should be consequences for unethical behaviour or breaking ebay rules.
If a person's track record is so bad that the tools show 'the warnings' then in my opinion, ebay should see that too and it should be up to ebay to ban that seller. It's not good enough to just say-oh well, it is your responsibility not to buy from those people.
I think there is a perception that if someone is selling on ebay and they have been there a while, then they overall are probably usually okay, even if there is some bad feedback. Well, as a buyer, you hope so, anyway.
Mind you, 96% would have me going in to read the negatives, I must admit!!

Ebay is not a neutral bystander, it has policies and rules - and billions of $$$ at its disposal to action its own policies and rules.
