I purchased a phone using the "buy it now" option and have not heard from the seller in regards to my purchase. I have tried getting in contact with the seller (I've sent an e-mail asking if the item has been shipped, and if so if they could send a tracking #), but have heard no response. The account which I purchased from seems to have only 1 other review and I suspect I may have been scammed. It's been 5 days since purchase and no response has been given, no tracking number, nothing. Should I continue to wait or file a complaint through ebay?

you have to wait for 10 days from purchase date to be able to put in a complaint, I hope you paid via paypal! seems phones are the dejour item to rip people off!

I did pay through paypal (thankfully). Thanks for letting me know the number of days I need to wait. I am counting down each minute in my head.

Keep in mind the 45 day cutoff for PayPal disputes...........if it was me then I'd open a dispute after 10 days or so if there's no communication.
I could be wrong but I believe a dispute can be opened after 4 days not 10 days.
If you could put the item No here someone can give you better advice on what to do - i.e. if it does look like a scam then the dispute should be opened earlier.

This is when the 10 days wait from purchase date is used ( for non paypal transactions)
You can open a case in the Resolution Centre 10-45 days after the sale (for payment outside of Paypal)

If you paid with PayPal, you'll be taken to the PayPal Resolution Centre to open your case. This is the first step in filing a dispute for protection under PayPal's Buyer Protection. You can open a case in the PayPal Resolution Centre up to 45 days after your PayPal transaction date.

For Paypal claims you can usually open one within minutes of making the payment if you wish, it is for ebay disputes that you have to wait.

ok, I tried to open a case today on an item I brought on the 16th and was informed on the paypal site I could logde a dispute on or after the 26th... thus my assumption of the 10 days...

You are correct, I just tried to open a case, to see what would happen, on an item I bought on 17-8 and got a message that it couldn't be opened until 27-8.
Hmmm, a new rule methinks..........................
