Item marked as posted but not posted

I bought and paid for an item that is situated in my state. I did this so that I could get it quicker.

I bought it on the friday. It was marked as posted on the tuesday. It is friday and I have not received it.

I emailed the seller and he informed me that the item is broken and he decided not to send it to me and is waiting on new items.

If that is so, why did he mark it as posted and why didnt he let me know.

I am disappointed and annoyed that he marked it as posted when he did not post it at all.  Is there any way I can cancel the transaction as I think I may have been conned.

Did the seller even give an estimated time before the item would be sent? If so, and you're prepared to wait that time, then I'd give them up to that point (and no more) before taking things further.

But I wouldn't be happy, either. I don't mind unexpected delays, but I do mind not being kept informed about my order status when things like that happen.

If you're not prepared to wait any longer or they haven't provided a reasonable time frame for it to arrive, I would first request a full refund from the seller. If they're not agreeable to that, your best option would be to open a dispute if you used a payment method like PayPal. Getting your money back if you used bank deposit or similar is next to impossible, unfortunately.

They should have kept you informed. Since they didn't, they could be telling you a bunch of dribble.

I agree they should have informed you, and they most certainly should NOT have marked posted and most likely did so to give themselves a breathing space. I would ask to cancel, if they are diagreeable open INR now, escalate to claim within the time frame allowed if still no parcel.

I would be hissed off and be opening an item not received dispute.

I they are smart they will refund you so you can buy from someone who has stock.

Misleading you into believing the item has been posted when they dont even have it to post would leave me feeling very negative about the transaction and I would be making my feeling known to them

Oh dear. This is so familiar to me as a seller.

Until I scaled down I was sending  four or five DVDs per day as large letters. Probably 90% arrived within a day or so. Of the rest, mostly within a week. Of those that were not 'mostly' then a couple of weeks or, in one case from Sydney to country Vic four weeks!

I'd already replaced the 'missing' item with my compliments to a good buyer who then ('cause he's a good bloke) returned the second DVD back to me. Of the hundreds I've sent only one has gone missing (I refunded NQA) and that my well have been nicked from his letterbox.

Allow more time. If the item is parcel size then a bit more time again (it is getting to peak season). Remember, you always have recourse through Paypal.

I just realised I'd skipped a bit of the OP. Ignore the above whilst I go find my meds.

I do a fair amount of buy-it-now from Chinese sellers and I've noticed a trend recently.

They quickly mark the item as "posted", usually same or next day. But when I receive it, the post marked date is 4-5 days later than that. So they actually send it 4-5 days after they've marked it.

I had one recently where I never received the goods after several weeks, so I went through dispute resolution, got a refund, then out of the blue, the item arrived - post dated much later than the where's-my-item enquiry! They didn't tell me what was happening, whether they had re-sent or anything.

I've been doing this for years and recently this deceptive practice seems to be getting more common.
