Paid for 2 items, never received items, opened dispute with Paypal, escalated to claim, Paypal did not find in my favour, I now have paid and have no items, BEWARE buying from this Seller and beware Paypal they do not always protect Buyers money or rights, I was wronged and will tell all I know never to buy from this Seller or use Paypal and expect any support. I am disgusted with Triastar they have stolen my money and not delivered my goods and I am equally disgusted with Paypal who have not helped me at all

Was the seller able to provide proof of lodgement and a tracking number for the item/s?
Is that why the case/s was/were found in their favour?

OK, I looked at the sellers feedback and it really is very good. This does not seem to be a common problem for them, especially compared to their volume of sales.(from memory, yours is the only case, and they seem quite happy to refund if a customer complains of a fault)
In the absence of further details, I can only assume that the seller did send your items and they were able to prove this to PayPal.
If that is the case, your anger is misdirected (although understandable).
It's really the carrier service that you need to be angry with.

Look at this from the Seller's perspective. They have an unknown costomer claiming they never received an item that they have sent and their delivery company is telling them that they have delivered it.
For all they know, you are not being honest about the receipt of the goods.
Now look at it from PayPal's perspective. Similarly, they don't know you either. All they have is your allegation that you did not receive your items, but they have proof from the seller that they did send them and the delivery carrier has confirmed they are delivered.
With the facts available at this stage, i do think that the negative feedback given to this seller was unfair.

The bottom line is I never received the goods I paid for and if it is the Courier Company's fault, then surely the Seller who engages that Company to deliver their goods must shoulder some of the responsibility.
Legally, no. (Morally is a different thing altogether, subjective, and varies from person to person).
Unless the package was insured in any way, then the seller's only legal obligation / responsibility is to seek that compensation, and - if granted - pass it on to you.
PayPal only facilitate claims against the seller, but as they seem to have done the right thing and posted it, thus being able to prove they posted it, the dispute in this instance is against the courier.

Please, please, please will buyers stop carrying on about their 100% feedback! That is all you can have as a buyer. And has nothing whatsoever to do with your issue.
Sellers with 100% feedback are to be treasured.

Hi I'm sorry to hear this, I have had a few problems myself lately. If paypal found in the buyers favour I am almost 100% sure they would have posted and have proof of this.
I am not sure where u live I am in Melbourne and have now got aus post looking into the delivery guy because strange things have been going on and I have tracking numbers so I know its not the sellers.
Funny thing is its the ones without tracking that are turning up without problems.
I have also just learned about locker boxes that are free to use and u get a sms to say your parcel has arrived. It open 24 hours and your post sorting location. and you get a sms code to safely get your goods and there is no way that it can go missing and if it did its 100% aus postproblem.
