I am sure I am not the first or last to have this problem and ask these questions, however I would appreceaite some feedback here.
I bought a blouse on Ebay recently. It was advertised as ‘in excellent condition”. I am only interested items that are new or in great condition so I went ahead, bid on it, and won the auction.
It arrived yesterday with another top and a note from the seller saying she noticed a “shadow’ mark on the blouse and so she included a second blouse as compensation. (I neither want nor need the second blouse.)
My problem is that the ‘shadow’ appears to be where someone has tried to clean it with something too strong and it has left a large pale and blotchy mark. Now, while the seller obviously thinks this is acceptable to wear I certainly do not. (I wish she had contact me prior to sending the blouse and I would have happily cancelled the purchase.)
I contacted her immediately but, as, yet, I have had no reply.
My questions are:
Is the seller required to pay for return postage?
Do I need to return the item before I can expect a refund? (I am reluctant to do this as I feel I may be putting good money after bad.)
Am I entitled to a make a claim through Paypal if the seller refuses to refund my payment?

The seller refunded without return.
How is your advice relevant? Even if what you posit is fact, which is debatable.

Hi I cant seem to find an 'add a new message tab'. So please excuse my posting inside someone elses post.
I purchased a 4-5kg mixed jewellery lot and paid a considerable amount. I gave the seller the benefit of doubt after seeing a few negetive feedback from the month previous. I put it down to 'a bad month' where nothing seemed to go right. I saw the 'no refund' marker, but still thought everything would be as it should.
Couldn't have been more wrong.
I received a late parcel, and inside was nothing that was in the pictures. I know because I had sat for three hours untangling the mess there, looking for the pieces that caught my eye upon bidding. I expected to do the untangling, so this is not the issue. I contact the seller, politely indicating I think they sent the wrong lot. They were quick to reply with defence and denied my claim. I returned a reply stating I could show the pictures I had taken to prove that this wasn't the lot I bid on, and that Im happy to return the lot in replacement for the right one. bidder refuse to budge, said I was being difficult. So I have raised a claim with paypal.
I am concerned that the words 'no refund' will be what prevents and compensation. I have searched for policies in ebay/google/paypal for possibilities or recouping my loss based on the fact the items do not match the pictures. The description itself was a fairly well thought out statement that could be used in template for many transactions. So Im contacting the discussion board to see if there is any advice out there to assist my claim.
I am prepared to take the items to a cop shop and sign a stat dec in proof that this heap of junk is what I received and it is definatley not what was advertised.
At a loss really.
