I need help. I brought a helmet and I chose a seller because the picture in the listing, as it had red detailing on the helmet, versus another listing. I received a helmet but it has white detailing on the helmet (not what I wanted). I questioned the seller and got this response:
"The helmet in our advertisement is the old model Sixsixone Dirt lid that our suppliers can not obtain. The helmet's are identical in every other respect.
If you are not happy with the colours, you are more than welcome to return the helmet for a full refund....."
I don't want to return this helmet as I am up for the postage costs and looking at the response above, the seller doesn't seem like the decent type to refund my costs.
I am astounded that the seller hasn't even indicated that they will change the listing photo and description. Should I just leave a neg feedback? should l lodge a paypal dispute? Or can I report the listing to eBay, so the next buyer doesn't go through this?

The sellers reply appeared to be polite - they apologised and said you were welcome to return it.
At that stage did you actually clarify with the seller who was going to be responsible for the return postage costs?
The problem is you then chose to let your son use the helmet which means you have accepted the product that was sent.
Any issue you had should have been fully resolved with the seller before allowing the helmet to be used.

Jens I think their point was that there is no way they would have paid to return it anyway so they may as well have let the son use it, the seller did not offer a cost free return or a partial refund for their mistake so in my book that deserves a neg.
It says in this book I am reading that by 2065 80% of women will be overweight.
See what a trendsetter I am?

We don't actually know if the seller didn't offer any refund of the return costs, the buyer just assumed they wouldn't based on a message received from the seller
I still would have asked the seller if they would pay for the return postage costs..
You keep using that word, I do not think it means what you think it means

Jens and Patchoo78, I did assume that the seller wouldn't pay the return post costs because of feedback and from their attitude in their response email. and I'm pretty sure I would have been correct.
About the use of the helmet, well I had to succumb to not returning it, as my son has no helmet that fits him and for safety he had to wear it.
But I think my biggest issue was this seller being able to sell something and not even have it in stock! I needed to know how to stop this and not have other buyers experience the same problem but now I know that feedback is the only way.

Sorry for jumping in but I got similar issue with a misleading and fraudulent seller.
He sold me a refurbished Microsoft computer mouse as "brand new".
Ebay is doing nothing to support me, Paypal said I'm entitled for a refund BUT:
- I will get a partial refund.
- I must send the item back at my expenses!
The mouse costs $16 while delivery fees is around $13!
This is a legalized scam and I'm so disappointed at eBay and Paypal for allowing such illegal activity!
What are my options?

My thoughts are along the same lines as Jen's. Without knowing exactly what was said in your message to the seller it is difficult to ascertain whether their response was appropriate.
Did you tell the seller that you specifically bought the helmet due to the colour of the stripe in the picture and had you known it was not the same you would not have bought it? Also did you ask them if you could return it for a full refund including return postage? The reason I ask is that the seller has responded politely and has not stated they will not pay the return postage. They have said you can return it for a FULL refund which to them may or may not include return postage.
I don't know how significant the differences are between the helmet listed and what you received. Unfortunately manufacturers/wholesalers often do change designs and will generally just substitute an item with the new design without advising the retailer. This is annoying for sellers especially online sellers who may not pick up on the difference until an item has been sold as depending on their volume of sales and number of stocked items they may not even realise the difference until it is pointed out to tyhem by a disgruntled customer.
Personally I would have responded to their message to clarify if they would pay the return postage given the item was not as described.
