Item not received paypal claim - paypal wants item returned to seller?

So my wife lodged a claim for an item from overseas that didn't show up.

 

She had contacted the seller, told them it hadn't shown, and yes, she waited quite a while for it to come. The seller refused to replace or refund, saying they will not do anything until the item bounced back to them (strange they would expect this to happen). We haven't changed addresses or anything so no logical reason it would go astray.

 

So she lodged an INR paypal claim, the seller continued to refuse to refund, adamant they wanted the item back. So it was escalated to a claim. Paypal is now telling her she must return the item with tracking and provide the proof of return before a refund will go through.

 

How is this able to be requested when the item has not arrived?

 

Do they read what they are writing or is their overseas call centre's subscription to google translate expired?

 

Has anyone come across this before? It is particularly baffling. Are we to post nothing back with tracking since nothing arrived?

 

We all know they are morons but this is next level stuff.

The only way the seller could demand this is if they have proof of delivery, which, if they cant show it,  there is something wrong with the system. Never came accross this one, but you will have to go hard with it and stand your ground. I recently had a case knocked back because an electrical item was unsuitable for the intended use because I ''should have known better than to just go on the sellers claims in the listing''. In other words, buyer be ware and dont read the sellers spruiking and praising about their product, because it doesn't mean jack if something goes wrong. Mine was definately item not as described, and I still lost out.

ring paypal and speak to them, explain it was item not received not a item not as described claim.

THAT'LL BE AS FRUSTRATING AS MESSAGING. I ALWAYS NEED TO HAVE MY BLOOD PRESSURE CHECKED AFTER ENCOUNTERS WITH PAYPAL OR EBAY FOR THAT MATTER. YOU'LL FEEL LIKE YOUR ON A MERRY GO ROUND AND JUST CANT GET OFF. GOOD LUCK !!

I am in the midst of another one myself (SNAD though) where the item "works" but not properly. Being accused by the seller of being difficult, accused of not hooking it up properly (electrical car component - I've been working with car bits since I was 5 so I know which wire goes where, his reckoning is that he's a tech and I'm not therefore I know nothing) and paypal has not even asked me for info and is already at the deciding outcome stage based purely on his info.

 

I'm going to be decidedly peeved if they think they can make a decision based on only info left by the seller, who incidentally argues that it is working, even though not correctly, so therefore is as decsribed. It was described as working 100% and perfect in the listing. At least if I lose it sets a precedent that can be raised with paypal if I sell something as working that does not work properly - they can't argue that its good for one but not for someone else.

 

Hate dealing with them.

Had a similar problem which could have turned with a loss of $900 for me if the seller had not been lenient, he sent registered but NOT INSURED (contrary to my request) that $900 item, I never received the item in my PO BOX: never received it, never signed for it ! Guess what 'happened? I had paid with PayPal, never mind they would not cover the loss (so much for 'buyer protection', this important fact must be kept in mind), Australia Post reimbursed me something like $100 and the seller....the difference ! One for you to ponder...

And did the seller return the balance to you? If paypal found in their favour, they would not have had money taken from them.

It does seem that Ebay and Paypal just do whatever pleases them at the moment eg fees on postage. They fully expect us to follow the rules but the same couresty doesnt seem to be paid in return. There is alot of unhappy people on ebay, sellers and buyers, they might be the master of their own demise.

Yes, the seller transferred the balance, so, imagining that he did send the item and refunded me and if the item was not returned to him (he will never tell me, I suppose, I gave him the benefit of the doubt...), he lost both, the item and &800 ! I took his word (that he had sent it, he had a receipt anyway...) and I truly believe that there are still very nice people (sellers) left on the planet. Australia Post told me that there is approx. 5% loss of all mailed with them, for no reasons they can understand (!), is it pure coincidence but at the time some AP employees were caught stealing from AP warehouse somewhere in Victoria (where the seller was from) is it related? Only them can tell, unless trhe cops would find this particular item in their 'inventory'...

Yep, eBay or PayPal can be astute in their advertising, in fact, they do not reimburse a loss ('Buyer protection' can turn into a deceptive motto...) that is why they insist on having the items registered , trackable and insured, it limits their liability, it did in my instance, refer my example above.
