Hi,
A lot of the items I've bought recently are not being delivered at all which has lead me to cancel a few orders. Recently I've tried to purchase iphone leather cases over ebay and it's just not being delivered. Is this an issue with ebay or something going astray at Aus Post?

I appreciate that it can seem like we are not working on any issues that have been raised but I would like to assure you that we are constantly working towards improving our services.
I would strongly recommend for anyone who is experiencing issues or has any specific enquiries to contact us directly. While these forums are monitored, for a swift response I would recommend using our Social Media channels, or the phone and website email function.
We need to be contacted directly about issues that people are experiencing so that we can ensure that every avenue is followed up and addressed. If we are not contacted directly for each specific issue then we do not know where the pain points are in the system so we can rectify them.
@zanadoo_56 with regards to your question: "How exactly do articles sent in Australia to Australian buyers, correctly addressed and of a size that will fit in a letterbox manage to still go missing? What is AP doing with them? It makes you wonder"
Articles sent within our mail stream are processed through many different channels, hubs and delivery centres before they reach the intended recipient. Normally this process is very smooth. In the instance of a delayed or missing parcel, we have processes in place where we can locate them, however if we are not contacted to advise that these items have not arrived then we just don't know.
Once we have received an official enquiry regarding an item, this is recorded in our Customer Management System. This system is frequently reported on by different areas of the business, who can identify any key areas where we're having trouble. This process of course again relies on any and all issues being reported to us directly.

maybe you could explain or answer the following?
1) Once a parcel/letter is lodged with Australia Post, can the sender retrieve that item, or is it now "the property of Australia Post"?
(lets say I posted a parcel and a few hours later realized I had forgotten to put something in the parcel and so wanted to retrieve it to correct this)
2) If the service offered by standard postage is that Aus Post will deliver a package from Point A (the place where package was lodged) to Point B (the addressee), then why is there a need for SOD or Insurance? Why do we have to pay more money to ensure that you do what you have been contracted to do?

Point 2 from crikey*mate - just what I was wondering!
The seller of my missing item did contact Aust Post but as the parcel was sent by ordinary mail the answer was 'There is nothing we {ie Aust Post} can do'.
I suppose that is a polite way of saying 'Bad luck you should have paid more money to send it if you actually wanted it to reach its destination'. I repeat - Aust Post has to do more. Registering every item is too expensive and time consuming, besides which (speaking from experience) it still isn't a 100% guarantee you will get your item.

I can certainly answer those questions for you.
An Article does not become the property of Australia Post while it is in the transit. It is still the sender’s property until it is received by the address. An item would only even become Australia Post property when the item remains unclaimed from our returned mail centre after 3 months.

1) The Postal Rule established in Adams v Lindsell states that the contract comes into existence at the moment that the acceptance was posted.
So how does this fit in, if someone takes the letter back? The offeror may be unaware of the acceptance, and I'm pretty sure that once a contract is formed, you can't just go "oops, I changed my mind".
2) I still do not understand why we have to pay extra for "peace of mind". Aus Post is a governemnt organization! I should be able to trust that they will do as they promise to do and not breach their contract without having to pay extra to make sure they do theuir job. Their job is to deliver my letter, surely it is up to you to prove that you did or didn't fulfil the terms of the contract.
Delivery should be a given, not a "cross your fingers and hope for the best" scenario.

Yes, I too thought that ownership passed to the receiver once an item was handed over to Australia Post. (Isn't this the reason why paypal requires proof of postage rather than proof of delivery for INR claims?)

ownership of goods actually passes over once the contract is formed (ie once the auction ends) betwen the buyer and the seller, regardless of whether money has been exchanged or delivery/collection has been attempted.

The issue of who owns goods, is not one that I expect AP will go into in detail about as they are just the carrier, and they have no knowledge if the goods they carry are subject to a sales contract or not, nor should they, it is none of their business, they just need to get the goods to where they are supposed to be going.
