Misleading item.. Damage.. unuseable...what do you think?

How does this stand? Set child's foam play shapes (the large type you climb all over) listed with pictures. Brief description but not covering condition or anything else. Provided with 3 pictures.

Go to pick up item (cash) and items are much more faded, torn, covered in black revolting mould, have awful rotting foam smell and sellers relative (who had them at his house storing them) claims he had them out in the garden for ages as they were taking up space in the garage and he agrees they are in Unsalvageable condition. They had such significant water damage that out of the 8peices, only 3 could of been cleaned up.. The rest were only suitable for the bin.

Seller I don't think is aware of current condition of items as they are being sold from a different location, I am hesitant to leave her negative feedback straight away as I doubt she would of sold them had she realised what bad condition they are in.. But she is messaging now asking me to complete transaction in next few days or will take it further, I've messages her back explaining why we did not proceed with transaction, because of misleading pictures and that because of the damage- items are actually now in-useable so therefore can't be listed as what they are. As a seller, I always take pics, describe flaws And as a buyer I understand that not all sellers do this and so never expect it to be as perfect.. but to purchase an item that can no longer be used for that purpose because of damage? I think it's misleading and refusing to pay,

yes mutual cancellation would be fine.. Just feel bad for next person who wins and hope they arent pressured into paying for something so bad.. she had two lovely chairs that ended tonight I was planning on bidding on but I cancelled my snipe because I didn't trust the condition after yesterday's drama...

I did politely suggest she relists item with up to date pictures etc and that I understood that as they were being stored for her she might not be aware of condition since she saw them last.


 


i'll email her and offer a mutual cancellation so she can do a 2nd chance offer.see how that goes, thanks everyone for your advice!

It's possible to do an advanced search on a member ID to see a list of bidding and purchase history from the last 30 days - as long as the items they bid on or bought weren't private listings, they'll be in the list. Most posters in the forum will do this when a buyer has a question to try and find the item referred to, see the listing and any relevant details that may clarify some things and help provide more accurate responses....and sometimes they're just a lil' nosey curious. :8} :^O

Oh thanks-- was curious too! Thanyou for your info... I'll see what she says tomorrow night when I am home from work and then I'll offer her the mutual cancellation thing.,, don't particularly care if she further it further but would hate to see her left with a perfect rating if I end up with a strike!

Update: seller has opened an unpaid item dispute. I understand that once its closed, I can't leave feedback but does that mean she can leave me net feedback?


 


how can I dispute the unpaid item dispute because of condition of items? D I have to open something separately to have the strike against me appealed?

When it's a pick up only item and a NPB dispute is opened you can phone ebay with all of the details ( make sure they know the item is unfit to be sold ) and if they do nothing then phone them to appeal the strike. Click on Customer Support in the top right corner of the page and follow links until the number appears.

Seller cannot leave you negative feedback.  I think the seller is being a bit unreasonable.  I would have accepted a cancelation and had a look at the items involved.


 


i would also ring e-bay and explain situation. Hopefully they will remove any strike.

This is why I won't sell items on behalf of other people or from other locations unless I have had the chance to inspect and photograph the items myself. Even if I have photographed items with the intention of selling on ebay and then they go back into storage for quite a while I will make sure I get more recent photos before listing.

I thought the items looked tatty in the original photos in the listing so if they are a lot worse than the photos they should be thrown out.

you need to respond to the dispute.


 


DO NOT PAY. Just write in the message box that the item is pick up only. You went to collect it from address as indicated and discovered that they were not as described, and covered in mould which is a potential health hazard for any child, so you refused to continue with the transaction.


Also mention that you have had several ebay emails with the seller explaining this.


 


 


See how that goes, also, do ring ebay. You wont be damaged by this transaction but she might be.
