I purchased a bike part which was advertised as 'New' and its not new at all, signs of wear and oil still on it.
But as it was advertised as new I did not check the images and the images show it has signs of wear.
The item was advertised as New and the description says condition is 'New'
Am I still able to complain / return / open a case ?

You could certainly try, with a not as described claim. Nothing to lose.
New should mean new, not 'as new' or 'excellent condition'.
Mind you, on ebay or anywhere else, (but especially on ebay) always look at the photos no matter what an ad says.

Open an INAD case via the resolution centre - https://resolutioncentre.ebay.co.uk/
The seller has 3 days to respond to the case and either refund or issue a pre-paid returns label. If you return the item, upon receipt back, the seller has 2 days to issue a refund.
Otherwise, escalate the case to receive a full refund.
