he may have sold the phone previously, but the first time, the sale might not have been finalized. The buyer may have changed their mind, might not have been able to afford it, returned it?
It appears by the feedback he left for the first buyer that they mutually agreed to cancel the sale.

Then as Lyn has found out, it looks like he has started and listed the same listing several times in one short period, leading me to believe he has made listing mistakes and didn't know he could edit etc,

I believe that your BIL was in the wrong to not pay for this item and hope that he does get an unpaid item strike. The time to ask questions and research a seller is before you commit to purchase and form a legally binding contract. Not after the fact.
