Hi all , today i had a dispute closed and in the favour of the seller.
The dispute was that the item had not arrived----it still hasn't.
There seems to be no avenue to dispute this decision , they(paypal) only allow a challenge if item is recieved and NAD.
In my case it hasn't arrived.
The Paypal conclusion was that the seller (USA) had provided proof of delivery and that was that.
This delivery required MY signature , and i have never signed for, let alone seen the item.
Any suggestions

JMO but you've pretty much been given all the obvious advice you need to follow up with Paypal-what else exactly do you want or expect ?

Sellers are bound by the rules of the site on which the purchase is made. I'm assuming you purchased via ebay.com.au therefore the seller only needs to provide 'proof of postage' and NOT 'proof of delivery' because that is what's required in Australia and is probably the reason why they found in the seller's favour.

If you dare care to look at Foxy's feedback you will see that she is a prolific buyer and has been for many years and Lyndal's makes Foxy's pale into insignificance, I have been buying and selling on ebay since before there even was an Australian site. Mist f the other responders know what they are talking about too so if you expect more I think you are going to be very disappointed.

Actually the sale is governed by the sellers terms and conditions.
The ebay country site that the sale took place can be legally proven by the final value fees that were charged to the sellers
account post sale.
The financial service that transfers the funds needs to comply with whatever countries ebay site that hosts the sale
The rest does not matter....
Paypal and ebay can try with smoke and mirrors to deflect those facts till the cows come home and call correct procedure a
"discretionary payment" when they are caught out.
The more that forego phonecalls (ie customers can transfer money in the blink of an eye with just one email ....but sometimes
those same customers cannot fix an obvious easy problem with a transaction no matter how many emails they send) to a
company that bills itself as the largest provider of internet transferrred funds in the world and do not accept the fob off...or expain
nicely to a supervisor but just reports them to the FOS and ASIC the sooner they will need to address that shortfall in service.
Think about why should you need to contact an internet money transfer company by phone to fix a problem...when you never
need to phone them to transfer your money intially?????

Hi All , just to clear up a bit of info , this trasaction was through Paypal but not an ebay item.
Thanks for all your inputs. I will be phoning Paypal today and will let you all know how it goes.

It is a fine time to say it is not an ebay transaction. A lot of the information given probably does not apply to your transaction.

All due respect lyndal did you read the subject line.
I clarified the situation at post 15 because it seemed a few others assumed ebay as well.

I did. Paypal dispute. No mention that it was nothing to do with eBay.
Given you came to the eBay boards about it, it is reasonable to expect it was an eBay transaction

Yes, I did read the subject line, and as davewil says....you are on the ebay boards so most people would assume it is an ebay transaction. You have already admitted that others have assumed the same thing.
And just for your information....there are differences in the rules for ebay and non ebay transactions so you do not necessarily have the correct information.
