Scammed by false tracking number

I recently been a victim of a false tracking number for an online order. I’ve seen so many people complain about this very same thing. I made a purchase, received tracking number from the seller and that led me to Orange Connex/SpeedPAK that sent my package to Australia. My package then received a new tracking number when it was then processed by AusPost for delivery. All my online orders before and have this particular order, has always prompted a text message to my phone requesting on how I’d like to receive my package. This would give me the option on the day of delivery, to choose whether I wanted it delivered to my home address or to the post office. Both of these choices would and have required me to sign for it. I did not receive the usual text message.
The tracking information said that my package was delivered to my suburb, which would be ok if I was the only one who lived there, but unfortunately I’d say that over 10,000 people live in my local area. So needless to say I did not receive my package. I did find out that according to both SpeedPAK who delivered my package from China to Australia and AusPost who delivered the package to my suburb, that the address on the package did not match my actual address. I went a step further and told the AusPost representative what I was expecting, a 6 inch Transformer that was made out of plastic and metal, a gift for my daughter. I was told by AusPost that whatever was in that delivery wasn’t what I ordered, as they confirmed that package that was delivered, not to my address, had the weight and size of a standard envelope.
Now you would think that, this would entitle me to a refund, having emails sent to me by SpeedPAK and AusPost that the package that was sent, did not have my address on it. All eBay needed to side with the seller was tracking information which doesn’t even terminate at my address to say case closed. This was approximately $100 item including delivery charge that I did not receive. Case closed even though I have emails from both Couriers saying that tracking number did not have my address on it, still eBay says case closed. So I got scammed and the eBay customer service department allowed it to happen because they are too lazy to do a proper investigation. Money back guarantee what a joke! And so I went to PayPal and they said the same thing no real investigation, tracking information says I got my package, even after I told them I have proof from both couriers in emails they sent saying the package did not go to my address.

According to the latest eBay Policy update on this type of scenario, if it states that it was "Delivered" in the tracking information, then it is deemed delivered regardless.

However, recently (Feb 2021) I opened a case in the resolution center where the item was deemed "Delivered" according to tracking information. Although the item was not "delivered". I confirmed with my own personal information (private video surveillance of my delivery areas), and eBay refunded me after i stated the facts. The eBay customer service representative stated that it was a "one off" courtesy refund.

Fact of the matter is that I have video evidence of a non-delivery, I also explained to eBay that I would close my account if the matter was not resolved ethically, and that i would also instigate Australian Federal Police Investigations into the matter for fraud, and also report it to the ACCC. The transaction was not through Paypal, it was Afterpay.

I will not mention the logistics carrier here, however it was an eBay contracted logistics carrier starting with the letter S and ending in K.

If the item is classified and advertised with the eBay money back guarantee logo, then it is bound by eBay's money back guarantee policy. Otherwise the eBay money back guarantee policy does not apply. That does not mean you cannot get your money back.

The seller is still responsible for delivery, and any failed delivery by the carrier in contract. If the Carrier cannot prove the delivery address then you can claim a refund so long as it is not an eBay money back guarantee item, otherwise eBay policy prevails under the eBay money back guarantee clause(s).

If you have solid evidence of the unethical act, then eBay must refund you in order to relinquish being a party to fraud on behalf of the seller.

have you also noticed that if you open a resolution center case against the seller, you cannot provide feedback when the case is closed. In future, Place feedback first if you can, then open the case. Make sure others know what the seller or their delivery courier is doing. Most of the time in these cases, the seller and the delivery person are in on the scam, or they are one and the same.

You have to be joking.....you are giving all this advice about reporting to ebay when the OP was posted more than 18 months ago.

 

By all means give advice here if you have anything to add to what has been posted, BUT do not give advice that is not able to be used......learn about the ebay and paypal claim timeframes.

 

And forget about the conspiracies perpetrated by couriers....it just does not happen like that.

Being posted 18 months ago does not make it invalid.

Otherwise there would be a function to close the thread to not allow any more posts.

Anything contrary would be unethical.

Many years ago an eBay representative came to the boards for an open discussion with members here, and she agreed that old threads SHOULD be locked, unfortunately that agreement was never fulfilled by the admins of the boards at that time or since then.

Yep....we all know it but cannot do anything about it.  We have to work within the ebay rules.

It sends out an entirely wrong message.

 

Of course we can do something about it.

 

I will not be brainwashed into thinking otherwise.
