Scammed for $3000 - eBay is refusing to refund.

Hello,

 

I bought an RTX 4090 brand new for $3000 AUD and the seller sent a fake tracking number.  Just a day before ebay was due to help, he added a tracking number that showed it was already delivered 3 days ago, but nothing ever arrived. My mum went to the post office and checked with them. and the new tracking number was an envelope when the item is 3kg+ and judging by the feedback a second victom gave, it probably wasn't even shipped to my address. eBay is refusing to help even with it being an obvious scam.

Just wanted to update,

 

I have been refunded conditionally the full amount via my bank last year, and the latest email from them was 2.5 months ago about updating me on the dispute when they have more information.

 

I am pretty happy that this situation feels over now, and the worst period of my life is behind me (I hope). 

Thank you for all your help, without you I would've never been able to give the evidence about the website providing the fake AUSPOST delivered form to the bank, as well as providing another victim's shipping label photo being exactly the same as mine (other than photoshopped address). Without that, this could've been an extremely sad ending.

How long ago was the estimated delivery date?

 

How are eBay refusing to help?

 

Did you open a dispute and if so what kind?

 

If you have proof the item was an 'envelope' that it is obviously 'not as described'

 

 

Did the tracking show it was delivered to your address?

 

Because of it did, and you opened an item not received dispute, that is an issue

 

 

How did you contact eBay?

 

Did you speak to a supervisor?

 

And point out the additional feedback?

 

What was their feedback like before  you spent $3000? (As a seller I mean) ?

There was a similar thread recently about receiving an envelope instead of the item (https://community.ebay.com.au/t5/Buying/Scam-sent-fake-item/m-p/2488931).

It appears that the OP of that thread was given a link after talking to eBay via live chat (I assume it was just a link to start a dispute, which they could have done themselves, but anyway...)

Can you please explain, as Sandy also requested, how eBay is refusing to help? If you use the right tools, you should be able to get your money back.

Edit: Two of the sellers who gave you fb in the past month (2 out of 3) have horrendous feedback. A seller's fb is always a good indicator of their reliability... Please avoid sellers with bad fb.

You bought on 26th October, so are within the timeframe for opening a dispute for Item Not As Described.

 

Open the dispute immediately to get a full refund.

 

Do not communicate with the seller unless through the dispute.

 

Read instructions carefully here -

 

When the item received by the buyer doesn't match the listing

 

eBay Money Back Guarantee policy | eBay

 

Do not let the dispute time out - ask ebay to step in and settle it. when the case allows.

Whatever you do, do NOT open a case for "Item Not Received", as this will close in the sellers favour as they can show "tracking".

 

Open the case for "Item Not as Described" as mentioned.

 

Do not be persuaded to close it under any circumstances.

That seller you started this thread about is even worse than the other two. 90.5% positive feedback! What blows my mind is that eBay calls this seller a 

Top Rated seller: One of eBay's most reputable sellers. Consistently delivers outstanding customer service.

And this seller is not even a big seller, like the Chinese sellers who sell a lot.

If you already opened a case for Item Not Received with ebay and they closed in the seller's favour, due to tracking saying delivered, you have 180 days to open a case for Item Not As Described in Paypal if that was your method of payment.

Can you please explain what you mean with "just a day before eBay was due to help"? Did you indeed open a case or do you mean the day before the last day of the estimated delivery (when you can open a case)?

And what do you mean with "eBay is refusing to refund"? It sounds like you might have opened the wrong dispute, in which case you should do what Stawks suggested, but we don't have enough details.

Did you check the tracking number - to see where it was actually delivered.

1. NOV 2nd was estimated. Delivered on 4th. Tracking provided 7th.

2. eBay has sided with the seller.

3. Yes, I did open a dispute, that I have not received my item.

4. I have proof from AUPOST, the delivery company that the item is an envelope that does not require signature, and wasn't sent to my address.

5. No.

6. Yes I did.

7. I contacted eBay via twitter and 12 times via live chat.

8. I could not get any ebay live chat support person to get me a supervisor. One rudely ended chat on me.

9. Before me and another person spent $3000 each, the feedback was pretty positive but on negative feedbacks, the seller was rude.

10. Account made 2022, the other buyer of the same product has the same issue as me. I provided this to eBay as well.
