Seller can't send to my address and trying to force payment

Hi,

So I need some advice on this.

Purchased an item, and on checkout discovered that they will not send to PO Box. (messages comes out in checkout)

Unforunately i only accept deliveries to PO Box.

There was no mention in item description that they do not send to PO Box, as I otherwise would not have purchased of course.

Asked to cancel transaction, but buy won't cancel and have opened a unpaid item case. Seller won't respond other than to ask me to pay, even offer to pay outside of ebay direct to paypal account and would send to PO Box then, Unforunately i have already purchased elsewhere from another seller who does not have this problem.

A day later i have opened a item not described case.

Any advice on what i should do in this case?

I have seen this happen quite a few times, sellers can't send to PO Box, but item description does not say so, i don't know until it is too late (i have committed to buying). Usually sellers are pretty good and we can mutually cancel.

I think it is a flaw in ebay system, if seller can't send to PO Box (shows up in checkout), then the item description should mention as well, so potentials don't try and buy it

Thanks.

Why did you decline the offer?

As long as you tick the box to say you are paying for goods you have full buyer protection regardless of if it is an ebay transaction or not.

No way can you win a dispute if you have not paid and no way can you appeal an unpaid item strike if you have not paid either.

I'm under the impression that if I do not pay by paypal via checkout, i do not get the full buyer protection right? Even if it is "send money" via paypal arranged outside of checkout.

Nonetheless, I could not pay via checkout, as long as i had a PO Box in the delivery details, it wasn't physically possible.

Further update, I performed a "report an item or listing violation" on the item, and i had a reply from a eBay rep.

They suggested digitalghost's advice of waiting out the unpaid item case, and lodging an appeal. It appears it may be considered even though i have not made payment.

"As of this moment, do understand that we need to wait until the seller closed the case before we can take necessary action. This is because there is a possibility that the seller will close the case on their end without you getting an Unpaid Item record. Anyway, do not worry, and please reply to this email as soon as the Unpaid Item case is closed. Rest assured we will further investigate your eligibility for an appeal and remove the record from your account based on our guidelines. At your most convenient time, you can take a moment to review our Unpaid Item overview, and our Unpaid Item Appeal information page, at the following web addresses:"

Also pointed me to this page:

http://pages.ebay.com.au/help/buy/appeal-unpaid-item.html

And there is a reason for not paying: "Seller changed the price, postage costs, or payment method after the sale."

So i'll follow that suggestion, and see what happens. Thanks to all your suggestions.

Andy, it was my suggestion right from the start (see Post # 1) that you should just wait for the dispute to close and then appeal the strike if the seller issued one.

However, after you mentioned that the item was worth less than $2 I suggested just paying as the seller requested.  There is a 99% chance that the item would arrive with no problems and even if it didn't the loss of a couple of dollars is not earth shattering.

No matter how you pay with paypal you have buyer protection for goods from all sources, not just ebay purchases, as PJ says.

I just don't understand all this angst over a couple of dollars.

My default address on file I think is my PO Box, but if a seller cannot send to that, I am happy to give them my address and pay for Registered Post

For those wondering what came out of this.

Unpaid item case expired and strike was recorded.

Strike was appealed (via listing violation case dialog) and subsequently removed by eBay.

Item not as described case, closed by myself.

Unfortunately this kind of thing is going to happen more in the future with Aus Post saying that new areas are not going to be provided with their service and everyone in those new areas will have to have a PO box.

where did this come from?  Not providing mail delivery to "new areas" ????? Do you mean new housing estates?  Where did you read/hear this?

Sounds like a lot of B.S. to me.
